A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing on April 8, 2008 .

Violet C. Matherson - Applicant proposes to construct a dock in the Great South Bay . The purpose of the project is to provide dock space for recreational vessels. The proposed project is located at 148 Wagstaff Lane, West Islip (Suffolk County, Town of Islip), New York.

A legislative hearing to receive unsworn comments about the proposed project will be held at 10:00 A.M. on February 5, 2008. A pre-adjudicatory hearing issues conference will be held at the West Islip Public Library immediately following the legislative hearing. The adjudicatory hearing will commence immediately after the issues conference on February 5, 2008.

Charles Dunne has applied to the NYSDEC for a tidal wetlands permit to reconstruct/expand an existing dock with a ramp on each end and a float.

A legislative hearing to receive comments will be held on January 15, 2008 at 9:00 AM. A pre-hearing issues conference will held immediately following the legislative hearing. An adjudicatory hearing will immediately follow the issues conference and continue day to day as necessary. All filings requesting party status must be received on or before 4:00 PM on January 2, 2008.

Stuart Venner has applied to the New York State Department of Environmental Conservation (DEC or Department) for a permit to construct a dock consisting of a 4' x 71' catwalk with a 3' x 12' ramp and a 6' x 20' float and to install two mooring piles west of the float. The proposed project is to be located at 5A Apacuck Road in Westhampton in the Town of Southampton, Suffolk County, SCTM # 0900-382-02-30.008.

A legislative hearing will be held to receive unsworn statements from the public on the permit application on October 17, 2007 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. The adjudicatory hearing is scheduled to take place immediately following the issues conference. All petitions requesting party status to participate at the adjudicatory hearing must be received by no later than 5:00 PM on October 10, 2007.

Gregory Pecoraro proposes to construct a dwelling, driveway and floating dock on a lot located on Kime Avenue near the intersection with Arbour Street, West Islip. The proposed dwelling and driveway would be located in the adjacent area of Class I regulated freshwater wetland BW-2, known as Deer Lake. The dwelling would be within sixteen feet of the wetland boundary. The floating dock would be located in the freshwater wetland. Clearing and ground disturbance is proposed within the adjacent area and ten feet of this freshwater wetland. In addition, ground disturbance to the freshwater wetland may result from the floating dock.

A legislative hearing will be held to receive unsworn comments on October 23, 2007 at 10:00 AM. Written comments may also be submitted either by mail or at the hearing itself. Mailed written comments must be received on or before October 16, 2007. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. All filings requesting party or amicus status must be received on or before the close of business on October 17, 2007.

Steven Kunreuther - The Applicant has applied for a tidal wetland permit and a freshwater wetland permit. These permits are necessary to expand an existing 2,500 square foot house to construct: (1) a 22' x 25' partial second story addition for use as a media room/office; and (2) an 8' x 25' unenclosed wood deck over an existing wood walk. DEC staff does not object to the issuance of the tidal wetlands permit nor does DEC staff object to the construction of the wood deck. DEC staff does object to the construction of the second story addition based on standards found in the regulations for freshwater wetlands permits.

A legislative hearing to receive unsworn comments will be held on July 31, 2007 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. The adjudicatory hearing is scheduled to be immediately following the issues conference and continue on August 1, 2007, if necessary. Jahanquir Yaghoobian - The hearing scheduled for June 12 and 13, 2007 has been cancelled.

Jahanquir Yaghoobian - The Applicant proposes to construct a retaining wall about 105 feet in length with two returns in the adjacent area of a tidal wetland on Little Neck Bay in the Village of Saddle Rock. Landward of the proposed retaining wall, Applicant proposes to place approximately 287 cubic yards of fill. The location of the project is 31 Bayport Lane North, Great Neck, (Town of North Hempstead, Nassau County), New York 11023.

A legislative hearing to receive unsworn comments about the proposed project will be held on June 12, 2007 at 10:00 AM. A pre-adjudicatory issues conference will be held immediately following the legislative hearing. The adjudicatory hearing will commence immediately following the issues conference and continue if necessary on June 13, 2007. 99 Lynn Avenue LLC, c/o B&L Management from a bluff at 99 Lynn Avenue proposes to construct a stairway and platforms to an existing bulkhead. From the bulkhead, applicant proposes to construct a catwalk into Shinnecock Bay, and a floating dock. The components and their respective dimensions are identified below.

A legislative hearing to receive unsworn comments about the proposed project will be held at 10:00 A.M. on May 15, 2007. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. Petitions requesting full party status to participate in the adjudicatory hearing must be received at the Office of Hearings and Mediation Services at the following address no later than 3:30 p.m. on May 9, 2007. The adjudicatory hearing will commence immediately after the issues conference on May 15, 2007, and continue if necessary on May 16, 2007.

Steven Laganas - A public hearing was scheduled to begin on February 27, 2007 concerning the application by Steven Laganas for permits from the New York State Department of Environmental Conservation. The hearing has been postponed, at the request of the Applicant and DEC Staff.

Steven Laganas proposes to remove and replace approximately 108 feet of bulkhead, at the same horizontal location but 18 inches higher than the existing bulkhead. Applicant also proposes to replace 15 feet of bulkhead return and a 5-foot-wide boardwalk that caps the bulkhead, and to place approximately 50 cubic yards of clean fill. The proposal also includes replacing in the same size and configuration an existing 29-foot groin, replacing an irregularly-shaped deck (17 feet by 18 feet) and an existing float (8 feet by 20 feet), and adding a 4 foot by 20 foot float as a finger perpendicular to the existing dock. The project is located at 2929 Shore Drive, on the Carman Canal, Merrick, Nassau County, New York.

A legislative hearing to receive unsworn comments on the proposed project will be held at 10:00 A.M., February 27, 2007. Written comments may be submitted at the hearing or may be mailed, to be received on or before February 23, 2007. A pre-adjudicatory hearing issues conference will take place immediately following the legislative hearing. The adjudicatory hearing is scheduled immediately after the issues conference. All petitions requesting party status to participate in the adjudicatory hearing must be received by the Office of Hearings and Mediation Services no later than close of business on February 23, 2007.

Thomas M. DeCillis, Tracey A. DeCillis, Thomas DeCillis and LeeAnn DeCillis have applied (Application #1-4734-02009/00001) to the New York State Department of Environmental Conservation ("Department") for a permit pursuant to article 15, title 27 of the New York State Environmental Conservation Law ("ECL") (Wild, Scenic and Recreational Rivers System), and part 666 of title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York ("6 NYCRR") to subdivide a parcel of real property consisting of 2.104 acres into two lots. The existing house would remain on one of the lots of 1.002 acres, and a dwelling, driveway and leaching pool would be constructed on the second lot of 1.102 acres. The subject lot is located within the Nissequogue Recreational River Corridor.

A legislative hearing to receive unsworn comments will be held on January 30, 2007 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. Hilge Hurford has applied for a tidal wetlands permit (application #1-4736-00819/00013) to construct a dock, ramp and float at 547 Meadow Lane, Southampton, Suffolk County, New York. Specifically, the proposed dock would consist of a 4' x 145' dock, a 3' x 20' float and two 4" x 6" float-securing piles.

A legislative hearing to receive unsworn comments will be held on January 16, 2007 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. The adjudicatory hearing is scheduled to begin immediately after the issues conference, continuing on January 17, 2007, if necessary. Michael Benincasa has applied (Application #1-4722-0251/00001 & 1-4722-02451/00002) to the New York State Department of Environmental Conservation ("Department") for a tidal wetlands permit and a freshwater wetlands permit to allow construction of a single family dwelling, deck, driveway, septic system and retaining wall at the northwest corner of Beaver Drive and Doe Place, Mastic Beach, Town of Brookhaven, Suffolk County, New York.

A legislative hearing to receive unsworn comments will be held on November 28, 2006 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. All filings requesting party or amicus status must be received on or before the close of business on November 21, 2006.

Jaral Properties has made an application for a Wild, Scenic and Recreational Rivers Permit and variance from permitting requirements to construct a 26,200 square foot paved parking lot for its Best Western Hotel Riverhead property, located at 1830 Route 25, Riverhead, New York, Suffolk County.

A legislative hearing to receive oral comments will be held on December 12, 2006 at 7:00 PM. Written statements must be received by December 12, 2006. A pre-adjudicatory hearing issues conference will be held on December 13, 2006 at 10:00 AM. All filings for party status must be received by December 5, 2006.

Mary Palmeri proposes to construct a single family dwelling, four dry wells, two 50' retaining walls, a pervious driveway, approximately 116 feet of steel bulkhead, 75 feet of stone armor wall, and a 33' x 4' timber catwalk on 10"-diameter piles with two sets of 4' x 4' stairs, and to place approximately 348 cubic yards of fill. The Applicant proposes the construction at her property, a vacant lot on the east side of Ocean Avenue, between 2711 and 2721 Ocean Avenue, 1,825 feet south of Bayview, on Silver Lagoon in Seaford, Town of Hempstead, Nassau County.

A legislative hearing to comment on the permit application will be held on November 14, 2006 at 10:00 AM. Written statements may be mailed in advance of the legislative hearing or may be given to the administrative law judge at the hearing. An issues conference will convene immediately following the legislative hearing. All filings for party status must be received no later than 3:00 PM on November 9, 2006. The adjudicatory hearing is scheduled to begin immediately following the issues conference.

Joseph and Margaret Kelly have filed a tidal wetland permit application to elevate the existing structure from the current foundation and to construct a two-story addition.

A legislative hearing to receive unsworn comments about the proposed project will be held on June 27, 2006. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. All petitions requesting full party status to participate in the adjudicatory hearing must be received no later than 3:30 PM on June 21, 2006.

Suffolk County Water Authority - Supplemental Notice - The proposed Middleville Road Well #3 would be located in the Lloyd Aquifer at a depth of 845 feet. The screen interval will be 801 to 841 feet. The well will have a capacity of 300 gallons per minute ("gpm"). Water produced by this well will be used only for blending with water produced by Middleville Road Well #1 to reduce the nitrate concentration of the water produced by Well #1. Middleville Road Well #1 is screened in the Magothy Aquifer at a depth of 470-540 feet below grade, with a 1,400 gpm capacity. The proposed well would be located on the south side of Middleville Road, approximately 2,300 feet west of Old Bridge Road, Town of Huntington, Suffolk County, New York (SCTM #400-60-1-1.002).

A legislative public statement hearing was held to receive unsworn statements on May 10, 2005. All interested persons may mail written comments postmarked by July 1, 2005. The record of the pre-adjudicatory hearing issues conference was opened on May 10, 2005. The record of the issues conference remains open until July 1, 2005 so that any additional petitions for party or amicus status may be filed. All petitions must be received by 4:00 PM on July 1, 2005. The issues conference will continue on July 12, 2005 at 10:00 AM.

Region 2 - New York City

NYC Department of Sanitation (Southwest Brooklyn Marine Transfer Station) submitted an application to construct and operate a converted marine transfer station in the Bensonhurst Section of Brooklyn, on a lot it owns bounded by 25th Avenue to the north, Bay 41st Street to the south, and Gravesend Bay to the west.

A legislative hearing will be held to hear and receive unsworn statements of the public on January 15, 2008 at 4:00 PM and 7:00 PM. Written comments may also be submitted to the ALJ and must be postmarked no later than January 15, 2008. An issues conference will be conducted on January 23, 2008 and continue on January 24, 2008, as necessary. All petitions requesting party status must be received no later than 3:00 PM on January 14, 2008.

NYC Department of Sanitation (East 91st Street Marine Transfer Station) - The applicant has submitted an application to construct and operate a converted marine transfer station at East 91st Street in Manhattan, adjacent to the East River and FDR Drive.

A legislative hearing will be held to hear and receive the unsworn statements of the public concerning the permit application. The hearing will be from 2 to 5 p.m. and from 6 to 9 p.m. on October 9, 2007. The issues conference will be in the Region 2 Office of the New York State Department of Environmental Conservation, 47-40 21st Street, Long Island City, New York. The conference will begin at 10 a.m. on Tuesday, October 16, 2007.

THE PORT AUTHORITY OF NEW YORK and NEW JERSEY - THE PORT AUTHORITY OF NEW YORK and NEW JERSEY -The Port Authority of New York and New Jersey (the Port Authority), is the operator of the John F. Kennedy International Airport (JFK) located in Queens, New York.

A legislative hearing on the proposed modified permit conditions will be held on June 4, 2007. A pre-adjudicatory hearing issues conference will be held on June 5, 2007.

Supplemental Notice - New York City Department of Sanitation (Spring Creek Park) proposes to operate a yard waste composting facility located at 12720-B Flatlands Avenue, Brooklyn, southeast of the intersection of Fountain and Flatlands Avenues, Brooklyn.

The date has been extended to submit written comments on the application and must be received by May 12, 2004. The date has also been extended to file petitions for party status and they must be submitted by May 12, 2004.

New York City Department of Sanitation (Spring Creek Park) - The Applicant proposes to operate a yard waste composting facility at 12720-B Flatlands Avenue, Brooklyn, an approximately 20-acre site consisting of fill material, located within an undeveloped portion of Spring Creek Park.

A legislative hearing to receive unsworn comments on the proposed project will be held on March 30, 2004 at 7:00 PM. Written comment may also be submitted to be received by March 30, 2004. A pre-adjudicatory hearing issues conference will be held on March 31, 2004 at 11:00 AM. All petitions requesting party status to a participate in the adjudicatory hearing must be received no later than the close of business on March 26, 2004.

Region 3 - Dutchess, Orange, Putnam, Rockland, Sullivan, Ulster, and Westchester Counties

Red Wing Properties, Inc. has applied for a permit to allow for the mining of sand and gravel from 69± acres on a total site of 192 ± acres. Mining and concurrent reclamation (initially as grassland) would be done in 7 phases of 10-12 acre increments. No material processing or weekend operations would take place. Weekday operations will be limited to 7:00 a.m. to 4:00 p.m. The project is located north of Turkey Hill Road, west of the intersection with Odak Farm Road, Town of Milan, Dutchess County.

A legislative hearing to receive unsworn statements will be held on August 14, 2007 at 7:00 p.m. A pre-adjudicatory hearing issues conference will be held on August 15, 2007 at 10:00 AM and continuing the next day, if necessary. All filings requesting party or amicus status must be received on or before the close of business on August 6, 2007.

Town/Village of Harrison - Supplemental Notice - PLEASE TAKE NOTICE THAT the location of the legislative public hearing originally scheduled for 6:00 p.m. on Monday, July 23, 2007 at the Harrison Public Library, 2 Bruce Avenue, Harrison, New York has been changed. The legislative hearing will now be held at the same time and on the same date at the Harrison High School cafeteria, located at 255 Union Avenue, Harrison, New York.

Town/Village of Harrison seeks to redevelop a NYSDEC brownfield site of 11.23 acres to establish within a municipal park, a recreational facility consisting of open space, a baseball field, a soccer field, a playground, walkways and a nature trail along with parking and service buildings to support these facilities. The project will encompass approximately 5.7 acres and would require approximately 10,000 cubic yards of imported soils to finish grade and provide the necessary top soil for seeding and sodding of the park areas. At the DEC's direction, and in anticipation of park completion, the top soil was not included in the brownfields project. The project is to occur within State-designated Freshwater Wetland J-3 (Class II) and as proposed, Harrison would fill in 0.39 acres of wetland and 1.7 acres of adjacent area. To mitigate the loss of this wetland and adjacent area, Harrison has provided 1 acre of enhanced 100-foot adjacent area. Harrison is also proposing to manage invasive Phragmites australis and other invasive plants by treating the identified areas of infestation with the herbicide glyphosate (a/k/a Rodeo) and replanting with native species on an area not to exceed 9.0 acres.

A legislative hearing will be held to receive unsworn statements from the public on the permit application on July 23, 2007 beginning at 6:00 PM. A pre-adjudicatory hearing issues conference will be held on July 24, 2007 at 10:00 AM. All petition requesting either full party status or amicus status must be received no later than close of business on July 17, 2007. Written comments may be submitted until close of business on July 27, 2007.

Mirant Bowline, LLC - Second Rescheduled Legislative Public Hearing and Issues Conference - The New York State Department of Environmental Conservation ("Department") proposes to renew and modify the State Pollutant Discharge Elimination System ("SPDES") Permit of the Bowline Generating Station, Units 1 & 2 ("Bowline"). Bowline is located on a small embayment of the Hudson River called Bowline Pond in the Town of Haverstraw.

Legislative hearing sessions to receive unsworn statements from the public on the application and the draft permit, will be held at 2:00 p.m. and 7:00 p.m. on March 29, 2006. The legislative hearing previously scheduled for January 31st and February 14, 2006 is rescheduled for March 29, 2006, no hearing will be held on January 31st or February 14, 2006. A pre-adjudicatory hearing issues conference is scheduled to be held at 9:00 a.m. on March 30, 2006. The issues conference scheduled for February 1st and February 15, 2006 is rescheduled for March 30, 2006, no issues conference will be held on February 1 st or February 15, 2006. All petitions must be received by 4:00 p.m. on March 15, 2006.

Mirant Bowline, LLC; - Proposes to renew and modify the State Pollutant Discharge Elimination System ("SPDES") Permit of the Bowline Generating Station, Units 1 & 2 ("Bowline").

Dynegy Northeast Generation, Inc., on behalf of Dynegy Roseton, LLC - Supplemental Notice - The New York State Department of Environmental Conservation (DEC) proposes to renew and modify the State Pollutant Discharge Elimination System (SPDES) Permit for the Roseton Generating Station (SPDES permit number NY0008231), located in the Town of Newburgh, Orange County, New York. A notice concerning this hearing was published in the Middletown Times Herald Record on April 18, 2005 and in the DEC's Environmental Notice Bulletin on April 13, 2005 (Dynegy Northeast Generation, Inc. (Roseton Generating Station)) - The New York State Department of Environmental Conservation (Department) proposes to renew and modify the State Pollutant Discharge Elimination System (SPDES) Permit for the Roseton Generating Station (Roseton, SPDES permit number NY0008231). The station is located in the Town of Newburgh, Orange County, New York, on the west shore of the Hudson River approximately at river mile 65. The draft permit contains conditions which address conventional industrial wastewater pollutant discharges, thermal discharge and cooling water intake. The draft permit prepared by DEC Staff would require Dynegy Northeast Generation, Inc. (Dynegy) to continue and to implement measures to reduce impingement and entrainment of fish and other aquatic organisms by the cooling water intake. The draft permit identifies performance standards for reducing impingement and entrainment mortalities.

Legislative hearing sessions to receive unsworn statements from the public on the applications and the draft permits will be held on June 14, 2005 at 2:00 PM and 7:00 PM. All written comments must be postmarked by June 2, 2005. A pre-adjudicatory issues conference will be held on June 15, 2005 at 10:00 AM. Filings for party status must be received no later than 4:00 PM on May 26, 2005.

Sullivan County Division of Solid Waste has submitted applications to expand the existing Sullivan County landfill, located south of Broadway in the Village of Monticello, by 35 acres, into an area referred to in the application as the "Phase II Expansion." The proposed Phase II expansion is separate from the Phase I (Cell 6) expansion that was permitted by the Department earlier this year. The Phase II expansion would consist of Cells 7 to 11 on the east side of the existing facility, in the direction of Rose Valley Road, and would allow up to 18 more years of landfilling. The Phase II expansion would partially overlap the existing landfill and raise the maximum height of the landfill by approximately 100 feet above the existing landfill height. The currently permitted maximum annual tonnage would not change.

A legislative hearing will be held to receive unsworn statements of the public relating to the permit applications will be held on May 5, 2005 at 3:00 PM and 7:00 PM. An issues conference will be held on June 13, 2005 at 1:00 PM. Filings for party status must be received no later than 3:00 PM on June 1, 2005.

Region 4 - Albany, Columbia, Greene, Delaware, Montgomery, Otsego, Rensselaer, Schenectady, and Schoharie Counties

Albany County Sewer District - Staff of the New York State Department of Environmental Conservation (DEC) requested an administrative hearing due to objections made by the Albany County Sewer District (permittee) to proposed changes to State Pollutant Discharge Elimination System (SPDES) permits for two sewage treatment plants, the North Plant and the South Plant, that it operates.

A legislative public hearing will be held on December 13, 2007 at 7:00 p.m. A pre-adjudicatory hearing issues conference will be held on December 14, 2007 at 10:00 a.m.

Shanty Hollow Corporation - Notice of Extension of Comment Period - Applicant has applied (Application #4-1936-00001/00001) to the New York State Department of Environmental Conservation (Department) for a stream disturbance permit for its operations at the Hunter Mountain ski resort, Hunter, New York. Applicant proposes to: make improvements to and continue maintenance and upkeep of the diversion weir in Schoharie Creek and inlet channel to Dolan's Lake; expand the existing water storage reservoir by 5.5 million gallons; construct a second water intake structure on Schoharie Creek at Deming Road; and construct a new water storage reservoir south of Deming Road with a capacity of 20 to 25 million gallons, all of which are being done with the purpose of continuing the withdrawal of water from the Schoharie Creek for snowmaking purposes.

Cobleskill Stone Products, Inc. - The applicant proposes to increase the life of mine boundary at its 86 acre Schoharie Quarry by 69 acres. In addition to the current 119 acre site, Applicant owns 77 acres between Rickard Hill Road and Warner Hill Road.

A legislative hearing will be held on June 12, 2007. A pre-adjudicatory issues conference will be held on June 13, 2007.

Erie Boulevard Hydropower, L.P. - The project is a hydroelectric facility that consists of five vertical Francis turbines with a generating capacity of 38.8 MW and is located on the Mohawk River. The project consists of the School Street Dam, which is a gravity dam that creates an approximately 100 acre reservoir. Water is diverted from the reservoir to the power canal, which conveys water to the powerhouse. At the School Street Dam is a gatehouse that is used to control the diversion of water to the power canal. The powerhouse is at the end of the canal and houses the five turbines. After exiting the powerhouse, water is discharged to the tailrace and then back to the Mohawk River. Historically, the project has been operated as a storage-and-release pulsing facility. Applicant typically fluctuates the reservoir between 156.1 feet mean sea level ("msl") to 153.1 feet msl. Applicant is also proposing to excavate and dredge approximately 65,000 cubic yards of bedrock and sediment from the power canal, which is located within the project boundary.

A legislative hearing to receive oral comments will be held on April 13, 2005 at 7:00 PM. A pre-adjudicatory hearing issues conference will be held on April 14, 2005 at 10:00 AM. All filings for party status must be received by 3:00 PM on April 6, 2005. All parties who previously submitted a petition for full party status in this proceeding must resubmit an updated petition or must provide a written explanation why their previous petition should be considered.

Region 5 - Clinton, Essex, Franklin, Fulton, Hamilton, Saratoga, Warren, and Washington Counties

Region 6 - Herkimer, Jefferson, Lewis, Oneida, and St. Lawrence Counties

M.J.L. Crushing, LLC proposes to develop and operate a 25.96 acre limestone quarry on a 33.8 acre parcel approximately one mile north of the Village of Lowville, west of NYS Route 26. On-site processing would take place, including: crushing, screening, and stockpiling. Blasting would take place three to five times per year. Mining would take place below the local water table, and pumping to a retention basin is proposed. It is anticipated that 150,000 to 300,000 tons of material would be removed per year, with a mine life anticipated at 15 years.

A legislative hearing on the application will be held to receive unsworn statements from the public pursuant to Title 6 of the New York Compilation of Codes, Rules and Regulations ( NYCRR) Part 621 on December 4, 2007 at 6:30 p.m. All interested parties may submit written comments at the hearing or by mail no later than December 4, 2007.

Sylvia K. Heumann has applied to the NYSDEC to modify permits issued on June 19, 1999. The original permits authorized dredging of boat slips in an existing boathouse located on First Lake in the Town of Webb, Herkimer County, New York, at 160 Indian Point Road. Applicant sought to modify those permits to allow additional dredging, to enlarge the boathouse from one slip to three, and to expand the existing boathouse. Both applications were received on December 14, 1999, and require a protection of waters permit pursuant to Environmental Conservation Law ("ECL") article 15 and part 608 of title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York ("NYCRR"). In addition, the project requires a section 401 water quality certification (see 6 NYCRR 608.9).

A legislative hearing to receive unsworn comments will be held October 22, 2007 at 10:00 AM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing. The adjudicatory hearing is scheduled to take place immediately following the issues conference. Written comments may also be submitted at the legislative hearing or mailed to be received on or before October 22, 2007. All filings requesting party or amicus status must be received on or before the close of business on October 16, 2007.

Le Roy Central School District - Applicant proposes to develop two Medina Natural Gas Wells for the Le Roy Central School District on school property in the Town of Le Roy, Genesee County.

A legislative hearing to receive unsworn comments about the proposed project will be held at 10:00 AM, on Wednesday, April 23. The adjudicatory hearing will commence immediately after.

Beach W1, Dzybon 1, Eolin 1, Gillis 1, Little 1, Lucas 1, Messing 1-B, Pietilla 1 - The Department proposes to issue compulsory integration orders pursuant to ECL 23-0901 integrating mineral interests within the spacing unit for each well listed above. Objections to the draft orders for each well listed were raised at a compulsory integration hearing, which resulted in the referral to the Department's Office of Hearings and Mediation Services for adjudicatory proceedings.

A legislative hearing to receive unsworn comments about the proposed integration orders will be held on July 18, 2007 at 1:00 PM. A pre-adjudicatory hearing issues conference will be held immediately following the legislative hearing and will continue on July 19, 2007, if necessary. All notices of appearance and all petitions requesting full party or amicus status must be received no later than 4:00 PM on July 11, 2007.

Seneca Meadows, Inc. has submitted an application for a 181-acre landfill expansion to be located adjacent to the existing solid waste landfill located on or adjacent to Route 414 in the Town of Seneca Falls, Seneca County, New York. The expansion will create approximately 31.2 million tons of disposal capacity and will allow an additional 14 years of landfilling at the current approved design capacity of 6,000 tons per day (average daily tonnage rate). The expansion was requested because SMI's current capacity will be filled in 2009. The Facility's existing Part 360 Solid Waste Management Facility Permit will be modified to cover all phases of construction and operation of the landfill expansion including the double composite liner system, leachate collection, grading, gas collection and control, stormwater management, tire processing, cover systems, closure and post-closure, waste filling, and environmental monitoring and noise monitoring. There are no changes proposed to the hours of operation. The Part 360 permit for the existing landfill will be modified to reference the Landfill Expansion engineering plans and reports.

A legislative hearing will be held to receive additional unsworn statements from the public on the permit application, draft permits, and the Draft Supplemental Environmental Impact Statement on May 21, 2007 from 6:00 to 8:00 p.m. A pre-adjudicatory hearing issues conference will be held on May 22, 2007 at 10:00 a.m. All petitions requesting either full party status or amicus status must be received at the DEC Office of Hearings and Mediation Services by no later than May 15, 2007. The comment period has been extended from May 4, 2007 to June 1, 2007.

Eastman Kodak Company - The Eastman Kodak Company for its Kodak Park facility, located in the City of Rochester and the Town of Greece in Monroe County. Kodak's various manufacturing processes generate hazardous wastes. In addition to hazardous wastes generated from these processes, Kodak may also accept hazardous waste from out-of-state Kodak-affiliated facilities, contractors performing work for Kodak, on-site non-Kodak tenant generators, and local municipalities (in the performance of a "public service").

A legislative public hearing will be held on March 12, 2007, at 7:00 p.m.

Seneca Meadows, Inc. ("SMI") - SMI's application includes a 178-acre expansion to be located adjacent to the existing solid waste landfill located in Seneca Falls, Seneca County. Applicant and staff of the New York State Department of Environmental Conservation ("DEC" or "Department") propose to convene the hearings and environmental review on this proposed project in two stages.

A legislative hearing will be held to receive unsworn statements on May 16, 2006. A pre-adjudicatory hearing issues conference will be held on June 6, 2006. All petitions requesting either full party status or amicus status must be received by 5:00 PM on May 30, 2006. The comment period has been extended to 10 days after the date of the legislative hearing. Comments on this project must be received by May 26, 2006.

Region 9 - Allegany, Cattaraugus, Chautauqua, Erie, Niagara, and Wyoming Counties

Buffalo Crushed Stone, Inc. - NOTICE OF EXTENSION OF PUBLIC COMMENT PERIOD - A notice of public hearing and issues conference was published on August 29, 2007 in the Buffalo News and on August 29, 2007 on the DEC's Environmental Notice Bulletin. The notice provides that a legislative hearing on the application and the draft EIS to receive unsworn statements from the public will be held on October 15, 2007 and that an issues conference will be held on October 16, 2007. The notice also provided for written comments to be submitted by the public by October 10, 2007.

Buffalo Crushed Stone, Inc. - The New York State Department of Environmental Conservation (DEC), as State Environmental Quality Review Act (SEQR) Lead Agency, has accepted a Draft Environmental Impact Statement (EIS) on the proposed Modification of Permit to Mine at the Como Park Boulevard Quarry located in the Town of Cheektowaga, Erie County. The proposed action is the mining of approximately 40 acres of land between the east and west basins of an existing hard rock (limestone) quarry. The proposed action would relocate asphalt and rock crushing plants and material stockpiles to the bottom of the east basin more than 100 feet below grade and will extend the life of the mine by about 20 years.

A legislative hearing will be held to receive unsworn statements from the public on October 15, 2007 at 3:00 PM and 6:30 PM. Written comments may be submitted at the hearing or by mail no later than October 10, 2007. A pre-adjudicatory issues conference will be held on October 16, 2007 at 9:00 AM. All filings for party status must be received by 4:00 PM on October 1, 2007.

Hyland Facility Associates proposes to increase the total permitted Hyland Landfill footprint from approximately 90 acres (28.27 acres of landfill cell area) to approximately 174 acres (76.27 acres of landfill cell area), and increase the maximum permitted overall height of the landfill by 68 feet, from 2,015 feet above sea level using the National Geodetic Vertical Datum established in 1929 (NGVD 29) to 2,083 feet NGVD 29. The maximum tonnage of waste accepted would also increase from 232,440 tons per year (745 tons per day) to 312,000 tons per year (averaging approximately 1,000 tons per day). If approved, the landfill life would be extended by 20 to 25 years, depending on the rate of waste receipt.

Two legislative hearing sessions will be held to receive unsworn statements from the public on October 3, 2006. The first legislative hearing session will be from 4:00 PM until 6:00 PM. The second session will begin at 7:00 PM. Written comments must be postmarked by September 27, 2006. A pre-adjudicatory hearing issues conference will be held on October 4, 2006 at 10:00 AM. All petitions requesting full party status to participate in the adjudicatory hearing must be received no later than 3:30 PM on September 27, 2006.
