NOTICE OF LEGISLATIVE PUBLIC HEARING

Applicant: Max Gurvitch, Island Realty Associates, LLC, 9520 Seaview Avenue, Brooklyn, New York 11236. Agent: Philip L. Rampulla, Rampulla Associates Architects, 155 Third Street, Staten Island, New York 10306 (Telephone: 718-987-1310).
Project: Develop 13 single-family detached houses with landscaping, patio and utilities. All of the proposed houses would be connected to city sewer and water supply. Five of the proposed housing footprints would be located in the adjacent area of Freshwater Wetland AR-3. The rear yard and proposed accessory structures on a sixth lot would be located in the adjacent area of Freshwater Wetland AR-3. The site is approximately 6.8 acres in area and the project would disturb more than one acre of land. The property is identified as Richmond County Block 2260, Lots 3, 23, 35, 55, and 71. The project site is located east, west and north of the existing private street known as Santo Court, and is directly opposite the intersection of Richmond Road and Wilder Avenue on Staten Island, New York.
Permits: Application for a permit pursuant to the New York State Environmental Conservation Law (ECL) Article 24 (Freshwater Wetlands Act), and Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR) Part 663 (Freshwater Wetlands Permit Regulations). In addition to a freshwater wetlands permit, the project would require compliance with the stormwater discharge requirements of ECL Article 17 and 6 NYCRR Part 750. Specifically, Applicant would submit notice to Department staff of its intent to conduct its activities pursuant to the State Pollutant Discharge Elimination System (SPDES) General Permit for Stormwater Discharges from Construction Activities (Permit No. GP-0-08-001).
SEQRA Status: The DEC Staff determined that the project is an unlisted action pursuant to the State Environmental Quality Review Act (SEQRA, ECL article 8 and 6 NYCRR part 617), and issues a Negative Declaration on September 11, 2009. No lead agency coordination was undertaken.
Public Hearing: Pursuant to 6 NYCRR Part 621, a legislative hearing session to receive unsworn comments about the proposed project will be held at 7:00 P.M. on January 28, 2010 at Community Board #2, 460 Brielle Avenue, Staten Island, New York 10314 (Telephone: 718-317-3235). Written comments may also be submitted, in advance of the legislative hearing session, to Daniel P. O'Connell, Administrative Law Judge, New York State Department of Environmental Conservation, Office of Hearings and Mediation Services, 625 Broadway, Albany, New York 12233-1550 (Telephone: 518-402-9003).
All persons, organizations, corporations, or government agencies which may be affected by the project are invited to attend the hearing and to submit oral or written comments. Interpreter services will be made available to deaf persons, at no charge, upon written request to the administrative law judge at least five business days prior to the date of the hearing. The hearing location is reasonably accessible to persons with a mobility impairment.
