Public Notice

Pursuant to Environmental Conservation Law 11-0303, 13-0105, 13-0339, 13-0340, 13-0340-b, 13-0340-e, and 13-0340-f the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

The NYS DEC - Division of Marine Resources (DMR) is filing a Notice of Emergency Adoption and Proposed Rule Making to amend 6 NYCRR Part 40 Marine Fish. The proposed rule would establish a Cooperative Multi-State Possession and Landing Program that would allow eligible commercial fishermen to: (1) possess weekly limits for quota-managed species for multiple cooperating states (NY, CT, RI) onboard the vessel simultaneously while fishing, transiting or landing, and (2) in one trip, land their weekly limits with the cooperating states.

There are no anticipated adverse impacts: there are no mandates for local governments, and there are no costs to NYS DEC, local municipalities, or the regulated public.

This notice will be published in issue 4 of the State Register on January 29, 2020.

State Pollutant Discharge Elimination System (SPDES) General Permit For Stormwater Discharges from Construction Activity Permit No. GP-0-20-001.

The New York State Department of Environmental Conservation (NYS DEC) has renewed the SPDES General Permit For Stormwater Discharges from Construction Activity, as GP-0-20-001. General Permit GP-0-20-001 will be effective from January 29, 2020 to January 28, 2025 and is a replacement for General Permit GP-0-15-002 which expires on January 28, 2020.

A draft of GP-0-20-001 was published for public review and comment in the Environmental Notice Bulletin (ENB) on July 24, 2019. The notice was also published, on either July 30, 2019 or July 31, 2019, in the following newspapers: New York Post, News Day, Albany Times Union, Buffalo News, Syracuse Post, Binghamton Press, Glens Falls Post Star, Poughkeepsie Journal, Rochester Democrat, Watertown Daily Times and Plattsburgh Press Republican. The comment period closed on August 30, 2019.

GP-0-20-001 is an Unlisted Action under the State Environmental Quality Review Act. A Negative Declaration is on file for SPDES General Permit for Construction GP-0-20-001. A coordinated review was not performed as per 6 NYCRR Part 617.6(b)(4).

Notice of Public Meeting on Household Cleansing Products Regulations (6 NYCRR Part 659)

Background: New York State Department of Environmental Conservation (NYS DEC) is holding a public meeting to discuss amendments to the 6 NYCRR Part 659 household cleansing product rules that are being considered for adoption. Amendments include specifying what information must be reported about covered products and their ingredients, how information should be shared with NYS DEC for the public record, the type of studies that must be reported, and how confidential business information should be handled.

During this meeting, NYS DEC is looking for input on disclosure of nonfunctional ingredients, issues around confidential information, and how to disclose when a product's formulation temporarily changes, as well as other regulatory concerns.

Notice of Complete Application

The New York State Department of Environmental Conservation (NYS DEC) proposes to issue conditional Water Quality Certification for a Transportation Regional General Permit (TRGP-1) proposed to be issued by the United States Army Corps of Engineers, as described in their public notice dated February 15, 2019, which is posted on their website at: https://www.lrb.usace.army.mil/Missions/Regulatory/Public-Notices/.
