Project Description:

This Department has received an application for a permit and has drafted an Air State Facility permit under Article 19 (Air Pollution Control) of the Environmental Conservation Law at the Oneida County Water Pollution Control Plant, the facility is located at 51 Leland Ave., Utica, NY 13502.

The Department has made a tentative determination to approve the application submitted by the Oneida County Sewer District, which provides activated sludge wastewater treatment from residential commercial and industrial facilities in a portion of Oneida County. The approval of the State Facility Permit is in addition to the currently issued, Title V Permit and will allow for the construction and operation of emission unit 1-DIGST. This emission unit will include: three exempt turbines that will fire biogas is generated from the new anaerobic digester system at the Plant, one elevated candlestick flare used as a control device when the exempt turbines are not in operation; three natural gas-fired exempt boilers will provide heat to the digester system; and three new emergency generators will serve as emergency power for the plant only. This state facility permit information will be added into the facility's current Title V Permit within one year of the commencement of operation of emission unit 1-DIGST.

The draft state facility permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

Installation of two (2) 24-inch sewer force mains in the bed and banks of the New York State Barge Canal. The proposed crossing is 1,500 feet east of the New York State Thruway Authority's Utica interchange. The proposed installation will occur during the Canal's draw down period through use of open trench excavation and dewatering methods. Impacts to the navigable water involves the excavation and fill of 940 cubic yards of material. The project will result in 1.92 acres of disturbance to the adjacent area of New York State Freshwater Wetland UE-6.
