Project Description:

The applicant has applied for a Water Quality Certification to authorize a proposed Federal Energy Commission license, FERC # P12635-002, to construct and operate the Mineville Energy Storage Project, a new underground pumped energy storage hydroelectric project that will utilize an existing flooded underground mine complex. The proposed project has a proposed generating capacity of 240MW. The upper and lower water reservoirs will be located in existing underground caverns with all components, exclusive of the entry building, to be constructed underground. Water in the mine will be discharged into an unnamed tributary to Mill Brook, C-86-5, over a period of 1.5-2 years in order to prepare for and allow for construction of the underground infrastructure. Thereafter for the life of the project, groundwater will be discharged into the tributary to prevent the mine from refilling with infiltrating groundwater. The proposed project is located adjacent to the largest known Indiana bat (Myotis sodalis) hibernacula in the northeast, which also serves as one of the largest northeast hibernacula for three other bat species of conservation concern. It is believed that a mine shaft connects the project site with the hibernacula, and the applicant has proposed a Bat Protection Measures and Action Plan (BPMAP) to monitor for and avoid any potential project impacts to the hibernacula.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a modification of the facility's State Pollutant Discharge Elimination System (SPDES) permit, pursuant to 6 NYCRR Part 750-1.18 and 750-1.19. The facility discharges, or proposes to discharge, up to 0.25 MGD of wastewater and/or stormwater to waters of the state via one outfall to the Schroon River. The current treatment plant includes: screening, 2 aerated settling lagoons in series, a sand filter and UV disinfection. Sludge is dewatered on-site. The proposed permit modification includes the addition of the chemical Slack Plus used in the existing sand filters and the addition of UV disinfection.
