Project Description:

The Department has made a tentative determination to approve this application for an Environmental Benefit Permit Strategy (EBPS) modification of a permit for an existing discharge of 0.25 MGD of treated sanitary wastewater to groundwater from a treatment plant at the applicant's facility located at 490 Oak St., Yaphank, NY 11980. Monitoring Requirements were added to the permit for pollutants expected in wastewater discharges. Refer to this application by application number listed above and SPDES number, NY0085693. The proposed discharge is located within an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas located within a 3‑mile radius of the applicant's facility: Suffolk County Water Authority.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to dredge a 21,300 sf area of Miller Place Pond, NYS-regulated freshwater wetland MD-19. to a depth of 25" in order to remove sediment and debris that has accumulated from stormwater runoff. A temporary access road will be established adjacent to the pond to provide equipment access, and the resultant 665 cy of material removed will be disposed of at an approved upland location. Drainage upgrades are proposed to reduce sediment levels in stormwater that enters the pond, and areas disturbed by the work will be revegetated. Miller Place Pond is located at the intersection of Lower Rocky Point Rd. and North Country Rd., Miller Place, Town of Brookhaven, SCTM# 200-28-7-1

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
