Project Description:

The applicant proposes to modify the Mined Land Reclamation (MLR) permit issued for the Harlem Valley Sand & Gravel mine, and also the MLR permit issued for the Northwest Farms mine (DEC Application No. 3-1320-00030/00011 for modification to the Northwest Farms mine is being processed separately), to allow the use of an existing farm road which connects the two adjoining mines for the transport of material from the Northwest Farms mine to the processing plant located at the Harlem Valley Sand & Gravel mine. Under current MLR permit(s) issued for the two mines, material excavated from the Northwest Farms mine is hauled approximately 1¼ miles on approved haul roads in order to be processed at the Harlem Valley Sand & Gravel mine. This proposed modification, together with proposed modification of the Northwest Farms MLR permit, will reduce transport distances between the two sites more than 50%. A total of approximately 0.6 acre would be affected under the two combined actions: 0.1 acre on the 150-acre Harlem Valley Sand & Gravel mine site; and 0.5 acre on the 198-acre Northwest Farms mine site. No other changes at either mine site are currently proposed. The Harlem Valley Sand & Gravel mine is located northwest of the intersection of Kent Road and Bog Hollow Road in the Town of Amenia, Dutchess County.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve this application to modify a SPDES permit (#NY0037117) with a surface discharge of 100,000 gallons per day (GPD) of treated sanitary wastewater from the Wildwood Sewer District (L&A). The modification relocates the existing effluent discharge point (outfall) from the unnamed tributary of Wappinger Creek, Class D, to the new outfall location on Wappinger Creek, Class B. The project will abandon the existing outfall and construct a new outfall on the bank of Wappinger Creek, resulting in approximately 16 linear feet of disturbance. The project is located at New Hackensack Road, Town of Wappinger. A draft permit is available for inspection and comment at the regional office; these documents can also be viewed and printed from the Department website at http://www.dec.ny.gov/permits/6054.html.

Project Description:

The applicant proposes disturbance to the adjacent area of DEC-regulated freshwater wetlands GO-33, class 1, associated with the development of the ~1.8 mile Segment 1 of the Heritage Trail Extension, from 500 feet west of Route 17, Village of Goshen to Hartley Road, Town of Goshen. A multi-use trail of 10-foot wide asphalt will be installed on the current gravel surface of the former railbed. No disturbance to the adjacent wetland is proposed.
