Negative Declaration

Orange County - The Town of Montgomery Planning Board, as lead agency, has determined that the proposed Matrix Development LLC Special Exception Use (SEU) and Site Plan for 7.3 MW DC, 5MW AC Utility Scale Solar Photovoltaic Array will not have a significant adverse environmental impact. The action involves a proposal by the applicant for approval of a proposed Utility Scale Solar array to generate 7.3 MW DC, 5 MW AC solar PV on approximately 26 acres of an approximately 60.7 acre tract of land located primarily in the 1-2 District on Maple Avenue in the Town of Montgomery. The site consists of two separate tax map parcels that will be merged, with the resulting combined lot having frontage and access on Maple Avenue. An easement to connect to the utility lines will extend across a third adjoining parcel having access to NYS Route 17K. The installation will operate according to the rules of the New York State Public Service Commission under the electric tariffs of Central Hudson Gas & Electric. The use is considered to be a utility scale solar system per the Town of Montgomery Zoning Law Section 90-120.

The proposed plan requires New York State Department of Environmental Conservation (NYS DEC) review and permit approval. As proposed, the plan would place solar panels within the regulated Adjacent Area of Freshwater Wetland WD-46, along with perimeter fencing outside the portions of the installation within the buffer, among other disturbance. The site is located adjacent to the Colden Family Cemetery, which is surrounded on three sides by the project site. The cemetery is listed on the State and National Registers of Historic Places. The project incorporates a minimum 100 foot setback from the nearest structural project element, which is the same measure recommended by new York State Office of Parks, Recreation and Historic Preservation (NYS OPRHP) in previous environmental reviews conducted for previous site proposals that were never constructed.

The project is located on Maple Avenue and NYS Route 17K in the Town of Montgomery, New York.
