Project Description:

The Department has received and made a tentative determination to approve an application from The Nature Sanctuary Society of WNY to apply the pesticide Pathfinder II, a NYS registered pesticide within it's Conewango Wetland Preserve to control the non-native, invasive species Eurasian honeysuckle. The herbicide application area is also within NYS regulated freshwater wetland CK-11, a Class II Wetland. The shrubs will first be cut near the stump and the plants either removed from the site or to a non-wetland area within the site. Pathfinder II will then be applied by hand directly to the stumps to kill the plants in order to help stop the spread of the plant throughout the wetland area and improve the habitat for various wildlife species.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 26, 2018.

Project Description:

The applicant proposes to add 3.6 acres of land to its existing 4.8-acre sand and gravel mine and to renew the permit for a 5 year term. The expansion area consists of 1.2 acres owned by the applicant and 2.4 acres from an adjoining parcel to the south and west of the current mine. The applicant has also applied for a Water Withdrawal Permit in connection with a washplant for material processing that includes a 1,200 gallon per minute (gpm) electric pump that transfers water in a closed-loop system between the settling ponds and wash plant, and a 155 gpm trash pump will be used to pump water from tributary 4 of Trout Creek to maintain source pond levels during dry weather periods. The mine is located on the west side of Sheppard Road and 1570 feet north of County Route 37/Hillside Road.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Aug 10, 2018.
