Negative Declaration

Livingston County - The Town of Avon Town Board, as lead agency, has determined that the proposed Local Law to Change Boundaries of a Portion of General Business District (B1) to Agriculture District (A) will not have a significant adverse environmental impact.

The proposed local law is intended to affect a modification to the boundaries of the General Business District (B1) to modify a portion of that district to a new classification of Agriculture District (A), said modified area consisting of approximately 4.58 acres of land located on the south side of NYS Routes 5 & 20 immediately to the east of Bronson Hill Road. The project is located at 6050 East Avon-Lima Road in the Town of Avon, New York.

Steuben County - The City of Hornell, as lead agency, has determined that the proposed City of Hornell Water Treatment Plant Upgrades will not have a significant adverse environmental impact.

The City of Hornell amended a Negative Declaration originally issued in 2016 for its Water Treatment Plant Upgrades project. Since then, the project scope has been updated following engineering investigations. The City found no significant adverse environmental impact from the updated project scope at its existing water treatment facility. The proposed work now consists of upgrade of an existing clarifier; replacement an existing water storage tank; installation an additional storage tank; installation of automation at the water treatment plant; and the repair of the automatic influent control valve. The purpose of the project is to replace aging and outdated water treatment infrastructure and improve the overall function of the water treatment facility.

The project is located on 7460 Seneca Road North in the City of Hornell, New York.

Wayne County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Montemorano Pit #4 - South Lyons Site will not have a significant adverse environmental impact.

The project involves a proposal by the applicant, Montemorano Bros, Inc., to add an additional 4.9 acre area to the currently approved 6.8 acre life of mine (LOM) at their Montemorano Bros #4 - South Lyons site. Approximately 50,000 cubic yards of material will be removed over a five to ten year duration of time. No other changes in the currently approved methods of mining or hours of operation are proposed. There will be no processing of material at the site and mining is not proposed below the water table. The site is currently agricultural land and will be reclaimed as grassland meadow.

The project is located on the east side of Old Pre-Emption Road and south of Bauer Road in the Town of Lyons, New York.
