Project Description:

The Department has prepared a draft renewed and modified Initial Air State Facility to Tech Park Owner LLC for its Rochester Technology Park natural gas and oil fired boiler plant, which provides steam for leased buildings at the former Kodak Elmgrove site.

As part of this application, Tech Park Owner seeks to maintain the ability to fire the boilers with either natural gas or #6 fuel oil, but still restrict NOx emissions to below the Title V and Part 227-2 NOx RACT applicability threshold of 100 tons per year by limiting #6 fuel oil use in any 12 consecutive month period.

Additionally, Tech Park Owner seeks to continue to avoid the applicability of 40 CFR 63 Subpart JJJJJJ National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers Area Sources by limiting #6 fuel oil use to periods of natural gas supply curtailment or interruption only.

The Department has generated a Draft renewed Air State Facility Permit which has been modified to include a 10 year permit term, a revised fuel oil sulfur limitation accordance with 6 NYCRR Part 225, and a permit condition referencing the applicability of 40 CFR Part 63 Subpart ZZZZ.

Project Description:

The applicant is proposing an environmental remediation program on the site of a former Manufactured Gas Plant. The proposed remediation is being conducted in accordance with a Department ordered program. As part of the remedial project approximately 2,200 cubic yards of material will be excavated from a 0.3 acres on the Seneca River and Canal. The area to be excavated will be isolated from the main flow of the river through the use of a turbidity curtain. Following excavation, the dredged areas will be backfilled with substrate which matches the upstream and downstream river bottom and the riverbank will be restored through seeding and planting. The US Army Corps of Engineers has authorized the proposed work under Provisional Permit No. LRB-2017-01394.

Project Description:

The applicant is proposing to modify the mining plan for a 14.9-acre area located in the northwestern portion of the existing 93.74-acre Life-of-Mine (LOM). The proposed modification area was previously shown on the mining plan as a processing plant but is currently used for haul roads, stockpiling materials and abandoned agricultural fields. As proposed, this modification area will be mined for sand and gravel with an excavator and dredge below the water table. There will be a permanent alteration of the existing topography within the modification area and the final reclamation in this area will be a pond with a depth of approximately 958 feet. According to the application, there are no proposed changes to the current day-to-day operations, hours of operation, or truck traffic at the currently permitted mine. No dewatering of the proposed modification area is proposed.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0021482, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Sodus Wastewater Treatment Plant discharges treated wastewater via Outfall 001 to an unnamed tributary to Lake Ontario, a class C water. Treatment consists of bar screen, grit removal, primary clarifier, aeration tank, two secondary clarifiers, sand filters, chlorine contact tank (inactive). The following changes to the permit are proposed: Administrative changes have been made to page 1; Monitoring requirement for flow added; Limits for specific parameters have been added, removed, and/or adjusted; Revised all limits to reflect (2) significant figures, except for settleable solids; Disinfection requirements and schedule of compliance have been added; Summer/winter periods for disinfection changed; A Mercury Minimization Program has been added; and, a new monitoring location page has been added. The permit includes updated forms and the latest general conditions. As a result of the EBPS full technical review, a new five-year term is proposed.
