Project Description:

DEC received a request from the permittee to modify the existing State Pollutant Discharge Elimination System (SPDES) permit to make the following changes:

  • The permittee has proposed to reduce the permitted design flow for Outfall 004 from 100,000 gpd to 90,000 gpd due to changes in the original development plan.
  • The permittee is also requesting removal of Outfall 005 from their permit. This outfall was designed for a potable water treatment facility that was never built as the facility is connected to a municipal water supply.

The department has made a tentative decision to approve the request and has drafted a modified SPDES permit. The proposed reduction in flow to Outfall 004 will reduce the sampling frequency of certain parameters from monthly to quarterly.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Project Description:

Oneida County Department of Water Quality and Water Pollution Control will repair and stabilize an exposed 24-inch sewer main on Sauquoit Creek located on the border of the Town of New Hartford and the City of Utica. The exposed segment of sewer main will be encased in concrete. An engineered riffle will be installed downstream of the sewer main crossing to aid in fish passage and provide grade control in Sauquoit Creek. Two (2) stream barbs will be installed along the western stream bank upstream of the sewer main crossing to deflect water away from the bank during high flows. A total of 24 cubic yards of concrete and 625 cubic yards of gravel and rock will be placed below the mean high water mark of Sauquoit Creek impacting 338 linear feet of protected stream.
