Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit # NY0281140 for a 133-room hotel, Phase 1A of the Bellefield at Historic Hyde Park project, to discharge up to 21,500 gallons per day of treated wastewater to Maritje Kill (Water Index # H-120; Class B). The draft permit and fact sheet may be viewed and printed from the Department web site at: http://www.dec.ny.gov/permits/6054.html.

The applicant also proposes disturbance to the bank of the Maritje Kill for construction of the sanitary system outfall and discharge of fill in federally-regulated wetlands for the outfall and the access road.

Availability of Application Documents:

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Hyde Park Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit NY0250520 for the surface discharge (Outfall 001) of a maximum of 0.97 mgd of treated sanitary wastewater to and unnamed tributary to the Ramapo River, a class C water.

Treatment at the facility consists of screening, primary sedimentation, rotating biological contactors (RBCs), secondary sedimentation, tertiary filtration, ultraviolet (UV) disinfection, and post-aeration. Primary and secondary sludge is thickened in a gravity thickener and hauled to a landfill. DEC proposes to incorporate the following modifications to this permit: new effluent limits for BOD5, UOD, dissolved oxygen, pH, ammonia (as N), Nitrite (as N), total residual chlorine, total copper, total dissolved solids, free cyanide, total phenolics, bis (2-ethylhexl) phthalate, and Whole Effluent Toxicity (WET) testing; additional limits for total phosphorus; new monitoring requirements for daily maximum flow, TKN, CBOD5, chloride, and sodium; new Low Priority Mercury Minimization Program; new Mini Pretreatment program; a Schedule of Compliance for dissolved oxygen, ammonia (as N), total dissolved solids, free cyanide, total phenolics, and bis (2-ethylhexl) phthalate has been added.
