Project Description:

Ceres Farms, LLC has applied for a water withdrawal permit for the withdrawal of 1.2 million gallons per day (GPD) of water from the Genesee River for 4 months a year, to be located on the western banks of the Genesee River, east of West River Road and north of Horseshoe Pond, for use in the agricultural operations of the Street Strong Farm. The applicant proposes to change the method of intake from a pipe in the river to a floating rotating screen intake. The Department has determined that the Facility is not eligible for an Initial Permit under Section 15-501.9 of the Environmental Conservation Law, therefore this is an application for a new water withdrawal although a similar, lesser withdrawal has been conducted at the site in previous years.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes the reconstruction of 5,771 linear feet of Whitney Rd between Turk Hill Road and Howell Rd to include milling, resurfacing, and shoulder reconstruction with the addition of gutters and sidewalks along portions of the roadway. These reconstruction activities will result in the permanent disturbance of 0.673 acres of the 100-foot adjacent area of NYS Freshwater Wetland PR-1 (Class 1) and 0.085 acres of the wetland itself.
