The Department has made a preliminary determination to issue Protection of Waters Permits, a Dam Safety Permit, and a Water Quality Certification to the Village of Sidney to restore Peckham Brook to pre-dam conditions in the area of Peckham Reservoir. The permit includes removal of 9,000 cubic yards from the dam to mitigate potential for catastrophic flooding.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

The applicant proposes to operate a new 1.7-acre sand and gravel mine on a 9.5-acre lot. A bulldozer and loader will remove bank-run gravel from above the water table, and an excavator will be used to dig material from below the water table. Material will be trucked away over a haul road and onto Peat Bed Road at a typical rate of two to three ten-wheeler truck trips per hour. The mine will be reclaimed to a .6-acre pond and 1.1 acres of graded upland with slopes no greater than one foot vertical to 2 foot horizontal.

Project Description:

The applicant proposes to develop and operate a new sand and gravel mine on the north side of Pellet Road.The mine will include excavation of bank-run gravel reserves using a pay loader, excavator, and bulldozer. A portable screener will be used to process the material. Mining is not proposed to go below the seasonal high-water table. An entrance to the mine will be constructed approximately 1,000 feet east of the intersection with County Route 21. The applicant reports truck traffic will be on average one ten-wheeler tip per hour, with a maximum of three ten-wheeler trips per hour. Upon completion the mine will be reclaimed to agricultural fields.
