The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 3 for an existing facility/electric power generating plant that operates thirty-two (32) combustion turbines/electric generating sets located on four barges. The combustion turbines are each rated at 299MMBTU/hr. Sixteen (16) of the turbines combust distillate oil only, while the remainder 16 units have dual fuel capability (oil and gas). Emission sources remain collectively identified as emissions unit G-00001. The previously permitted installation and operation of one (1) LMS 100 combustion turbine/generator set at the GGS facility which would have fired natural gas and ULSD is rescinded under this draft permit, and negates the Title IV Permit which will not be renewed under this draft permit. The Title V operating permit provides enforceable emissions restrictions on the entire facility with Emission Unit G-0001: 32 combustion turbines and starter diesels.

The facility continues to be maintained under the NOx RACT System Averaging Plan for Astoria Generating Company, L.P

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has made a tentative determination to approve this permit modification based on a December 29, 2017 request received from the New York City Department of Environmental Protection (NYCDEP) related to the completion of a requirement of the Total Residual Chlorine (TRC) Consent Order (R2-20120604-312). The draft permit has been modified from the existing SPDES permit in the following ways:

  • Updated first page of permit to reflect new formatting, current NYCDEP Deputy Commissioner, and current NYSDEC Permit Administrator;
  • Revised final TRC limit from 0.53 mg/l to 0.20 mg/l;
  • Removed Footnote (2) -Following completion of review of the ambient water quality monitoring program, as required by the TRC Consent Order, the Department may reopen the permit to revise the TRC limit through a permit modification; and
  • Updated forms incorporating the latest general conditions.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
