Proposed Rulemaking to Amend Water Quality Standards Regulations and the Classification of Upper and Lower New York Bay

The purpose of the proposed rulemaking is to amend Parts 700, 703, and 890 of Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (6 NYCRR) to adopt new standards for enterococci and E. coli to meet the requirements of federal law and to upgrade the classifications of certain surface waters in the New York Harbor.

NYS DEC will present an overview of the proposed rulemaking at both meetings. Note that these are information meetings only, and no public comments will be accepted at these meetings.

The purpose of the public hearings is to accept oral and written comments on the proposed rulemaking.

Public Comment on the Proposed Rulemaking

The public comment period commences on March 21, 2018. Written statements may be submitted to NYS DEC - Division of Water, 625 Broadway, 4th Floor, Albany, NY 12233-3500, attention: Michelle Tompkins or by email to BeachRule@dec.ny.gov. Written statements must be submitted to NYS DEC by midnight on June 12, 2018.

Public Hearing

At the public hearings to be held on June 5, 2018 and June 7, 2018, attendees will have an opportunity to make an oral statement and/or file a written statement. It is not necessary to file a written statement or request in order to appear to make a statement at the hearing. Written statements received prior to, during, or after the hearing (before the comment period closes), and oral statements made at the hearing will be given equal consideration.

Public Information Meetings and Public Hearing Facilities/Services

The public hearings and public information meetings are scheduled at locations reasonably accessible to persons with a mobility impairment. Interpreter services will be made available to hearing impaired persons, at no charge, upon advance written request received by NYS DEC (see contact information below) within a reasonable time prior to the scheduled hearing and information meetings.

Environmental and Regulatory Impact Review

NYS DEC has determined that the proposed revisions will not have a significant adverse environmental impact. NYS DEC has prepared a Regulatory Impact Statement, a Regulatory Flexibility Analysis for small businesses and local governments, a Rural Area Flexibility Analysis and a Job Impact Statement, in accordance with the State Administrative Procedures Act.

New York State Department of Environmental Conservation (NYS DEC) Invites the Public to Comment on Salmon River (Oswego County) Fisheries Management Plan

The purpose of this fisheries management plan is to guide efforts and resources toward enhancing the Salmon River's status as New York State's premier, year-round angling destination for lake-run trout and salmon (salmonids) over the next 15 years (2018-2033). The Fish Community Objectives for Lake Ontario (which can be found on the Great Lakes Fishery Commission website at: www.glfc.org/pubs/FisheryMgmtDocs/Fmd17-01.pdf ) are the foundation of this Plan which was developed in close consultation with a variety of Salmon River stakeholders. The Plan's focus is on higher level objectives and management strategies aimed at maintaining or improving the lake-run salmonid fisheries in the 17 miles of the main stem Salmon River and its major tributaries below the Lighthouse Hill Reservoir.
