Positive Declaration and Public Scoping

Genesee County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Dolomite Products Co., Inc. - LeRoy Quarry Expansion may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted by the contact listed below until March 16, 2018. A copy of the draft scoping document may be viewed at the NYS DEC - Region 8 Office in Avon during normal business hours by calling the contact person below or during normal business hours at the LeRoy Town Hall. Electronic copies of the Draft EIS scoping document may also be obtained by request to the contact person listed below.

The currently permitted mine is located south of Gulf Road between Circular Hill Road and Church Road in the Town of LeRoy, New York. The mine includes an approximately 159.67 acre mine consisting of the drill and blast surface excavation of consolidated limestone as well as processing. Processing currently includes crushing, washing and screening which will continue in its current location. Stormwater and groundwater would continue to be pumped from the existing sump located in the eastern part of the quarry (SPDES permit No. 0247189). As proposed, the expansion would include approximately 29 additional acres southeast, and contiguous to, the existing mine in the Town of LeRoy. The proposed expansion would require the realignment of approximately 2,515 linear feet of Mud Creek and portions of the corresponding floodplain. As with the existing quarry, the majority of the proposed expansion area would be reclaimed to open water. Dolomite is also proposing a change in the permitted hours of operation from 7:00 a.m. to 5:30 p.m. Monday through Friday to 6:00 a.m. to 7:00 p.m. Monday through Friday and 6:00 a.m. to 12:00 p.m. (noon) on Saturday
