Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 0036714), pursuant to 6 NYCRR Part 750-1.18 and 750-1.19, the Priority Ranking System know as New York State's Environmental Benefit Permit Strategy (EBPS).

The facility is a 48,400 gallon per day (gpd) rotating biological contactor treatment plant serving the Lily Dale Sewer District.

The following changes to the permit are proposed:

  • The longitude of Outfall 001 has been changed to more accurately reflect its location on Middle Cassadaga Lake.
  • The minor drainage basin has been corrected from 01 (Allegheny River Main Stem & Tribs) to 02 (Conewango Creek).
  • A Mercury Minimization Program for Low Priority POTWs has been added to the permit.
  • The seasonal disinfection period has been changed from May 15 - October 15 to May 1 - October 31 for consistency with other seasonal requirements.
  • The effluent monitoring requirement for Phosphorus has been replaced with a Monthly Average limit of 2.8 mg/L, consistent with TOGS 1.3.6.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit is available for review.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received and made a tentative determination to approve an application for the construction of a single family home and pool within a portion of the regulated 100 foot adjacent area (AA) of NYS Freshwater Wetland CC-49 on property located at 520 New Road. The proposed house and maintained lawn will impact 0.56 acres of the AA, however most of the house lot footprint falls within a previously disturbed area. The project will also include approximately 1.2 acres of wetland restoration and approximately 0.96 acres of adjacent area restoration on the property.

As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 15, 2018.
