Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a new Air State Facility permit for Hebrew Home for the Aged at Riverdale consisting of multiple buildings at 5901 Palisade Ave, Bronx, NY 10471 on a 19 acre campus. The facility proposes to build a cogeneration plant. There is a central power plant, and smaller heating/cooling units are also located in individual buildings. The application and draft permit contains the following fuel combustion sources: four boilers burning natural gas and No.2 oil: two 12.6 MMBtu/hr and two 16.5 MMBtu/hr; two exempt Weil McLain boilers burning No.2 fuel oil; fifteen exempt small boilers/hot water heater (4-AOON & 11-Riverwalk) burning natural gas; six diesel and one gas-fired emergency generators, all exempt; seven exempt TecoChill gas-fired engines (161 bhp each) burning natural gas, all with 3-way catalyst at the exhaust; two lean-burn Caterpillar gas-fired engines (1,150 bhp each) with oxidation catalysts at the exhaust.

The facility will monitor all fuels delivered/burned at all of the above equipment and calculate monthly the 12-month rolling oxides of nitrogen (NOx) emissions. The facility NOx emissions are capped at 24.9 T/yr. Records demonstrating compliance with this cap will be kept in accordance with the permit specific conditions. The facility is subject to the provisions of State Facility specified under 6NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and specific monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Energy Research and Development Authority

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V Renewal 3 for an existing facility that operates a Co-Generation Power Plant for Riverbay Corp Co-Op City, a housing development consisting of approx.15,000 apartments, 3 shopping centers and 8 garages, all heated and cooled by the plant. The facility operates six emission units: Emission Unit U-00001 a 371 MMBtu/hr low pressure Riley Stoker boiler firing natural gas or ultra-low sulfur distillate (ULSD) No.2 oil with low NOx burner (LNB) and Flue Gas Recirculation (FGR) Oxides of Nitrogen (NOx) control as part of the NOx Reasonably Available Control Technology (RACT) Plan; Emission Unit U-00002 a 414 MMBtu/hr high pressure Victory Energy boiler firing natural gas or ULSD No.2 oil, and replaces the former low-pressure 371 MMBtu/hr Riley Stoker Corp boiler (Emission Source 00002 in Emission Unit U-00002) as part of the facility's NOx RACT plan; Emission Unit U-00003 212 MMBTU/hr high pressure and low heat release Rentech Model D Watertube boiler firing natural gas or ULSD No.2 oil low LNB and FGR; Emission Unit U-00004 a 12 MW (131 MMBtu/hr) Siemens GT-400 Combustion Gas Turbine firing natural gas or ULSD No.2 oil with 60.7 MMBtu/hr duct burner and Selective Catalytic Oxidation (SCR); Emission Unit U-00006 a 12 MW (131 MMBtu/hr) Siemens GT-400 Combustion Gas Turbine firing natural gas or ULSD No.2 oil with 60.7 MMBtu/hr duct burner and SCR; and Emission Unit U-00007 a 1,500 KW diesel fuel engine generator unit that is re-classified from an emergency generator to a "peak shaving unit" in the CDRP (electric grid or peak shaving program) with a cap operational limit of 1,055 hours annually. The facility is applying for a NOx Variance for this non-emergency generator.

The facility operates other sources which are considered exempt from permitting per 6 NYCRR 201-3.2(c): 2 emergency diesel generators (<500 Hrs/yr each), 2 distillate fuel oil storage tanks (<300,000 bbls capacity), 3 storage tanks (<10,000 gallons capacity), and 5 non-contact water cooling towers and water treatment systems.

The renewal draft permit continues to include 6 NYCRR Subpart 201-7 Federally Enforceable Emission Caps and 6 NYCRR 227 Presumptive NOx RACT emission limits for distillate oil fired stationary internal combustion engines as part of the facility's NOx RACT plan. For Emission Units U-00004 & U-00006 for particulate emissions operating hours are limited to 4,320 hrs/yr (Processes 007, 008, 012 & 013), 2,160 hrs/yr (Processes 008 & 013), 14,000 hrs/yr (Processes 07, 012, 008, 013, 009, 014, P10 & 015), 7,000 hrs/yr (Processes 008, P10, 013 & 015) and natural gas consumption is limited to 320 MMCF/year (Processes 011 & 016). For Emission Units U-00001 & U-00002 ULSD No.2 oil consumption is limited to 6.11 MMGallons/yr (Processes 017 & 030) and natural gas consumption is limited to 2,912 MMCF/year (Processes 002 & 040). For Emission Units U-00001, U-00002 and U-00003 natural gas consumption is limited to 4,748 MMCF/year (Processes 020, 040, 006), and ULSD No.2 oil consumption is limited to 13.72 MMGallons/yr (Processes 017, 030, 005). For Emission Unit U-00003 and Process 005 for PM-10 emissions ULSD No.2 oil consumption for Boiler HPB03 is limited to 5.49 MMGallons/yr.

Information regarding the demonstration of the Lowest Achievable Emission Rate (LAER) and the demonstration of the Best Available Control Technology (BACT) is available in the regional office and may be reviewed upon request. This renewal continues to include federal conditions and Compliance Certifications under: 40CFR 52.21(j) Subpart A, 40CFR 60 NSPS Subpart IIII, 40CFR 63 Subpart ZZZZ, 40 CFR Part 68, 40CFR 72, 40CFR 75, 40CFR 82 Subpart F and 40CFR 89.112 Subpart B.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
