Project Description:

The applicant proposes the installation of approximately 6,800 feet of 8-inch watermain and associated appurtenances along portions of Telephone Road, Broadway Road (Route 20) and Sandpit Road in the Town of Alexander. An Article 24 Freshwater Wetlands permit is required as a 1,050 linear foot portion of the watermain will be located underneath State Freshwater Wetlands BS-35 and BS-36 and within associated regulated Freshwater Wetlands adjacent areas. Work in the wetlands will be completed by directional drilling, with temporary disturbances within the 100-foot adjacent areas for boring pits, and open trench installations. Three Class A stream crossings will also be made by directional drilling to unnamed tributaries of Tonawanda Creek. Impacts are anticipated to be temporary and all disturbances will be located along the roadway. Once the water main is installed, the area will be restored to existing conditions. As a tentative determination, the Department seeks comments.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Alexander Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Applicant proposes to install approximately 5,561 linear feet of new 4-inch diameter gas pipeline by both open trench method and directionally drilling within the right-of-way of Whittier Road. The directional drill method will include eight (8) drill pits totaling approximately 600 square feet of temporary disturbance and open trench method with temporary disturbances of 1,131 square feet both within the 100-foot adjacent area of State Freshwater Wetland OG-6 (Class 2). Erosion and sediment controls will be used to minimize potential impacts to the wetland.
