Project Description:

The Dutchess County DPW proposes to realign 0.1 miles of Dutchess County Route 72 and reconstruct its intersection with Hurley Rd to improve safety and functionality. Project activities include reducing the horizontal road curvature, widening the shoulders, reducing the slope of Hurley Rd, making drainage improvements including culvert replacement and installing stormwater management features, and making line of sight improvements on Hurley Rd at Woodland Dr. This project will permanently disturb 3,200 square feet of the state regulated 100 foot adjacent area of NYS Freshwater Wetland SP-48 (Class II).

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 350 gallons per minute of water from an on-site well for cooling purposes. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes disturbance to approximately 550 linear feet of the bed and banks of Rondout Creek (Water Index Number H-139-14, class B) associated with re-contouring the bank slope, installation of a new slope toe in the bed of the Creek, and placement of 1,300 cubic yards of rip rap below Mean High Water. The project also involves replacement of an existing 48-inch stone culvert with a 50 linear foot, 60-inch HPDE pipe culvert on an unnamed tributary of Rondout Creek (Water Index Number H-139-14-4, class C), replacement of a 114 linear foot, 36-inch culvert on an unnamed sub-tributary of Rondout Creek (Water Index Number H-139-14-4-1, class AA), and construction of a 56 linear foot, 20-foot-high retaining wall at the outfall on Rondout Creek. A 5-foot-wide pedestrian walkway will be installed parallel to Rondout Creek. The proposed work is located on DEC Flood Control Project Lands and requires a Flood Control Land Use permit.
