Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) Permit for modifications to Terminals C and D as a part of the La Guardia Airport East Side Reconfiguration Project. The existing Air Registration (ID: 2-6301-00767/00002) will be discontinued upon ASF permit issuance. Delta is proposing to install: five natural gas hot water boilers, 12.0 mmBtu/hr each; three natural gas snow melters, 67.5 mmBtu/hr each; one Cummins 2000DQKAE (2.0 MW) diesel emergency generator; one Cummins 1750DQKAD (1.75 MW) diesel emergency generator; and three Cummins 1500DQGAF (1.5 MW) diesel emergency generators. Delta currently operates two 12.4 mmBtu/hr natural gas boilers, and will retain these boilers until such time that the new East Side Terminal equipment is constructed, commissioned, and operated. The application and draft permit also contains exempt emission units.

The Oxides of Nitrogen (NOx) will be capped at 24.9 T/yr, including exempt and trivial activity sources. During the construction, startup, and testing of the new equipment, the existing East Side Terminal equipment will continue to operate to provide requisite heat, power, and snow melting capacities when needed. Delta will continue to track fuel use to demonstrate that the annual actual emissions are below 24.9 tons of NOx, such that the existing facility equipment and proposed equipment are subject to the provisions of State Facility requirements specified under 6NYCRR 201-7. Records demonstrating compliance with this cap will be kept in accordance with the permit specific conditions.

The draft permit contains federal conditions 40CFR 60 NSPS Subpart IIII and 40CFR 63 Subpart ZZZZ Compliance and Enforcement. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Empire State Development

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve an Air State Facility permit renewal for an existing dry cleaning facility. This renewal includes a modification to replace an existing perc dry cleaning machine with one using hydrocarbons. The facility operates three perc dry cleaning machines and one hydrocarbon dry cleaning machine. The facility annual perchloroethylene usage is capped at 2,100 gallons per year as per 6NYCRR Part 232.2(b)(41). Records demonstrating compliance with this cap will be kept in accordance with the permit specific conditions. The facility is subject to the provisions of State Facility specified under 6NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and specific monitoring requirements for the facility.
