Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 0036714), pursuant to 6 NYCRR Part 750-1.18 and 750-1.19, the Priority Ranking System know as New York State's Environmental Benefit Permit Strategy (EBPS).

The Wastewater Treatment Plant serving the Town of Concord Sewer District No. 1 consists of secondary treatment by activated sludge aeration, sedimentation and then disinfection. Waste activated sludge is stored in an aerated sludge holding tank prior to being hauled off site for disposal. The design of the plant is 0.072 MGD.

The following changes to the permit are proposed:

  • Change in Supervisor from Gary Eppolito to Clyde M. Drake.
  • The location of Outfall 001 has been changed to more accurately reflect its location along the streambank.
  • Total Residual Chlorine: The seasonal effluent limit has been lowered from 0.7 mg/L to 0.0933 mg/L to reflect current division Guidance.

The modification also includes several other minor reporting modifications. The facility has a surface discharge into Cazenovia Creek (West Branch), a class B water.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit is available for review.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve an application for the construction of two homes that will result in 0.03 acre of impact to Wetland BW-9 (limited to a driveway crossing) and 2.50 acre of impact to the regulated 100 foot adjacent area (two single family home lots). The proposal also includes the establishment of a buffer around all development areas within the two lots that will minimize direct impacts to Wetland BW-9. A vernal pool mitigation project is also included within the overall design which will offset the small loss of wetland. The project meets the Departments Part 663 compatibility and weighing standards. The project is located off of Love Road in the Town of Grand Island. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to approve an application for the construction of a 0.40-acre pond. The project will disturb the regulated 100 foot adjacent area Freshwater of Wetland WO-13. Due to a 20-foot offset from Freshwater Wetland WO-13 the active hay field composition of the proposed construction area and relatively small size of the proposed pond, the project will have minimal impact on wetland buffering functions. The project meets the Departments Part 663 compatibility and weighing standards. The project is located off of Hunts Corners Road in the Town of Newstead. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
