Project Description:

The project sponsor proposes to construct 26 residential lots and an associated access road crossing NYS Freshwater Wetland MB-39 (Class II) in association with the implementation of Phase 3 of the Village approved "Highgrove Subdivision" located at the western end of Ahern Blvd.

Project activities will disturb approximately 19 square feet of NYS Freshwater Wetland MB-39 (Class II) and 30,070 square feet of its state-regulated 100 foot Adjacent Area, in order to construct the access road with associated culvert, water and sewer lines, and stormwater management features. In addition, the project will include approximately 7.3 acres of tree removal that will take place between November 1st to March 31st to avoid impacts to Indiana bat (NYS Endangered) and Northern Long-eared bat (NYS Threatened).

The Village of Washingtonville has agreed to extend supply and distribution mains of their public water supply system to provide water service to the project. The Village of Washingtonville will submit a separate application to the Department to obtain a Water Withdrawal Permit approving the extension the Village water withdrawal system into this new service area.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Washingtonville Village Planning Board

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to disturb a portion of the 100 foot Adjacent Area of NYS Freshwater Wetland K-9 (Class I) in order to extend an existing drainage pipe, construct a riprap stone dissipater, and widen an existing trail to serve as a construction access road. Activities proposed within the Adjacent Area include excavation, fill, and grading. The total area of disturbance to the Adjacent Area is 0.19 acres; there is no disturbance proposed within the Freshwater Wetland. The project is located at the Westmoreland Sanctuary, east of Woodcrest Drive, in the Town of North Castle, Westchester County.
