Project Description:

The Department has made a tentative determination to approve a request for a new water withdrawal permit and a modification to the existing SPDES permit at the applicant's construction site located in Brooklyn and Queens, NY, where the applicant is replacing the Kosciuszko Bridge. The purpose of the water withdrawal and SPDES modification is to implement a thermal control plan required for cooling the mass concrete of the pylon footing and lower pylon placements. The request adds a temporary withdrawal and discharge of a maximum of 216,000 gallons per day of non-contact cooling water sourced from the Newtown Creek to the currently permitted maximum discharge of 65,000 gallons per day of treated groundwater from construction dewatering associated with construction of the bridge piers and stormwater collection infrastructure for a new maximum combined discharge of 281,000 gallons per day from Outfall 001. State Environmental Quality Review (SEQR) Determination:

A final enviromental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: NYS Dept of Transportation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
