Project Description:

The project involves the placement of approximately 3,500 cubic yards of rip rap within an existing deteriorating barge footprint to provide a permanent breakwater for the protection of an existing marina within the Hudson River (Water Index Number H, class B).

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to disturb less than 0.1 acre of the 100 foot Adjacent Area of NYS Freshwater Wetland NB-28 (Class II) in conjunction with reconstruction of an existing church on Winona Avenue. The proposed project also impacts a federal wetland area. Due to the proposed impacts to this federal wetland, the applicant is required to provide one acre of wetland mitigation area. The applicant proposes to construct the mitigation area within the 100 foot Adjacent Area of NYS Freshwater Wetland NB-21 (Class I) on Pomarico Drive approximately 3 miles from the project site. Activities within the Adjacent Area include construction, excavation, filling, and grading; no disturbance to the wetland is proposed . The project is located at 12 Winona Avenue and the north end of Pomarico Drive, in the Town of Newburgh, Orange County.
