Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a modification to State Pollutant Discharge Elimination Systems (SPDES) permit NY0028991.

The facility discharges treated wastewater via Outfall 001 to Ishua Creek, a class C(T) water. Treatment at the facility consists of grit chamber, aeration tank, clarifier and chlorine contact tank. Sludge is sent to waste management, Chaffee, New York.

The DEC proposes to extend all milestone due dates in the schedule of compliance by six months. Details of changes are specified in the draft permit and statement of basis which may be viewed and printed from the DEC web site at: http://www.dec.ny.gov/permits/6054.html.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to issue a State Pollutant Discharge Elimination System (SPDES) Permit (No. NY0275867). The applicant proposes to discharge from ten outfalls, including stormwater/groundwater outfalls (outfalls 001, 002, 01A, 003, and 007) and landfill leachate outfalls (outfalls 004, 04A, 04B, 005, and 006) associated with an existing 3 acre capped Construction and Demolition Debris (C&D) Landfill, and the construction and operation of a 34.9 acre C&D Landfill.

The new landfill will have a constructed leachate collection system, where wastewater will be collected and stored, and then trucked offsite for treatment at another facility. The existing landfill cell discharge pipes are to be routed to a sediment basin, then ultimately discharged to surface water to an intermittent tributary of Storehouse Run at Outfall 004. Treatment for this wastewater is provided through a settling basin with an effluent weir. Throughout construction of the new landfill cells, stormwater will be collected and pumped to storage/settling basins to be filtered prior to discharge to groundwater and/or Storehouse Run, a class C(T) waterbody.

Any waste contacted water is to be considered leachate and must be treated through Outfall 004 or at another facility offsite. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought. Refer to this application by the application number listed above and SPDES Number NY0275867.

The Department has also prepared a draft Solid Waste Management Facilities permit, Air State Facility permit, Water Withdrawal Permit, Stream Disturbance Permit and Water Quality Certification for this proposed Carroll C&D Management Facility. The draft permits represent NYSDEC's tentative determinations, and do not signify staff's approval for, or endorsement of, the proposal. The Department, as lead agency, has also accepted a Draft Environmental Impact Statement (DEIS) on the proposed Carroll C&D Management facility.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
