SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation has made a tentative determination to issue a permittee-initiated modification of a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. The approved application is for the discharge of 18,000 gallons per day of treated sanitary wastewater into the East Branch Fish Creek, a Class C(T) waterbody, from the applicant's facility located in the Town of Annsville, Oneida County, New York. This modification will also serve to renew the SPDES permit, for which the term was extended under the State Administrative Procedures Act (SAPA).

Proposed changes include: revised effluent limits and monitoring requirements based on a reduced design capacity from 32,000 to 18,000 gallons per day resulting from treatment plant upgrades and operational changes; extended seasonal disinfection (May1 through October 31); addition of a Pollutant Minimization Program for Mercury; and revised permit pages to reflect current NYSDEC format and nomenclature.
