Project Description:

The applicant proposes to mine unconsolidated sand and gravel material on approximately 30 acres out of a 48-acre parcel of land at this location, to an approximate depth of 35 feet. Material processing includes use of a portable dry-screen and a closed loop wash plant. There will be no mining into the groundwater table other than to establish two small ponds dug as a source pond and settling pond for the wash plant. After mining ceases the mine floor will be reclaimed to land suitable for agricultural purposes with stable vegetated side slopes no steeper than 1:3 vertical to horizontal. The two ponds may remain after reclamation for farm use, otherwise they will be filled and revegetated along with the mine floor. The project site is located approximately 300 feet east of Strunk Road and 1150 feet north of Interstate 86. An existing farm road from Strunk Road will be used as an entrance into the southern portion of the mine.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal and modification to an existing federally enforceable Air State Facility permit for Moldtech, Inc., located in Lancaster, New York. The facility produces a variety of custom rubber molded products for industries. This permit is for a modification that would add 4 additional spray booths, giving the facility 4 additional new emission points that will facilitate the bonding of rubber to metal or plastic. The existing emission caps which limit annual potential emissions to avoid requirements of 6 NYCRR Part 201-6, will remain unchanged. Moldtech is required to annually certify continuous compliance with emission limits established in this permit. The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

Project Description:

The Department has received and made a tentative determination to approve an application for an Air State Facility permit for the above-referenced facility. Prestolite manufactures large and small frame alternators, large starter motors and electromechanical instruments. This permit will replace the existing Title V permit for the facility because the facility emissions have been reduced below major source thresholds due to the removal of emissions sources, process modifications and business changes. Prestolite has decommissioned four (4) die-casting machines from Emission Unit P-00004, removed one heat cleaning oven from Emission Unit P-00006 and removed Emission Unit P-00011 which includes one emergency compression ignition engine and one emergency fire pump.

Prestolite is required to document facility-wide emissions remain below major source thresholds for total volatile organic compounds (VOCs), total hazardous air pollutants (HAPs) and Methyl Isobutyl Ketone as determined by summing the individual monthly emissions during any consecutive 12-month period. Prestolite must also maintain the 50 ton per year Oxides of Nitrogen (NOx) emission limit for emission unit P-00009 established when the emission unit was newly permitted in June 2004. The facility must operate emission unit P-00009, the diesel fuel-fired stationary reciprocating internal combustion engines used to test starter motors manufactured at the facility, in accordance with 40 CFR 60, New Source Performance Standards, Subpart IIII and 40 CFR 63, National Emission Standard for Hazardous Air Pollutants, Subpart ZZZZ.

As a tentative determination, the Department is seeking public comments, prior to making a final decision on permit issuance.
