Project Description:

The applicant proposes removal of manufactured gas plant (MGP)-related contamination within two operating units (OU02: Brandy Brook and OU03: Pontiac Bay on Lake Flower) of the Saranac Lake Gas Co, Inc. site, a class 2 inactive hazardous waste disposal site, as follows: OU02: Brandy Brook - Sediment and soil removal (5,800 cy) within a 29,000 sf area, excavated to 4.5 feet, impacting approximately 1,360 linear feet of Brandy Brook. In the wetlands bordering Brandy Brook, an estimated area of 25,272 sf of emergent and scrub-shrub wetland is expected to be impacted. OU03: Pontiac Bay on Lake Flower - Sediment and soil removal (16,900 cy) within a 71,650 sf bay area to a depth of up to 7 feet, impacting approximately 175 linear feet of Pontiac Bay bank/shoreline. Excavated contaminated sediment and soil will be trucked off site and disposed of at an approved disposal facility. The remediation site will be restored to existing grades with plantings in accordance with an approvable restoration plan.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Construction of a 6,000 sq ft Pet Lodge with associated 3,900 sq ft fenced-in play yard, driveway, parking lot, stormwater management practices and on-site septic system on a +/- 1.59 acre parcel on the east side of South Broadway just north of Kaydeross Avenue. Development of the lot will result in the disturbance of a portion of the regulated adjacent area of DEC Freshwater Wetland S-24 (Class 2) for the construction of a stormwater bioretention facility.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
