Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a State Facility Permit for Russin Lumber. The purpose of this is to transition Russin Lumber from a Registration to a State Facility permit, so they may generate more product in the event of an increase in demand. Russin Lumber operates a wood coating process for exterior siding materials. They utilize two brush coaters to apply semi-transparent and opaque stains to the wood products. Coated wood products are air dried on portable racks located inside the building. They will be using coating compliant to the volatile organic compound content limits of 6 NYCRR Part 228. Emissions are vented through a fan opening. Emissions of total and individual hazardous air pollutants and volatile organic compounds will be limited to below major source thresholds, as defined in 6 NYCRR Part 201. Therefore, the facility is not subject to the requirements of Title V of the federal Clean Air Act.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

Persons wishing to inspect the subject files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below. Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

The project involves disturbance to the adjacent area of DEC-regulated freshwater wetland ML-13, class 1, associated with the demolition of an existing 673 square foot single-family residence and the construction of an in-kind, in-place, single-family residence that will be elevated above base flood elevation. Approximately 1,300 cubic feet of soil will fill in the existing foundation.

The facility has applied for a modification of its initial water withdrawal permit. The facility increased water withdrawal capacity from 230,000 gallons per day (gpd) to 1,958,400 gpd in 2012 by increasing water storage within on-site irrigation ponds. The Department proposes to issue a modified permit allowing up to 230,000 gpd of water withdrawal from Lake Eida and 864,000 gpd of water withdrawal from on-site irrigation ponds.
