Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) permit modification for an existing permitted facility. The draft permit authorizes the operation of a combustion installation consisting of five Easco PLW-331 Low Pressure Boilers rated at 11.1 MMBTU/hr each and five exempt CHP Units rated at 1.8 MMBTU/hr, to provide heat and electricity to residents. The facility is converting from No. 2 fuel oil to natural gas as its primary fuel source to the five boilers onsite. The application includes five Tecogen lnVerde INV-100 e+ combined heat and power (CHP) modules operating in cogeneration mode with the existing boilers, classified as an exempt activity per 6 NYCRR 201-3.2. The facility nitrogen oxides (NOx) emissions will continue to be limited to 24.9 T/yr. The draft permit includes federal conditions 40CFR 60.48c(f)(1) NSPS Subpart Dc Compliance Demonstration, and 40CFR 63 Subpart JJJJJJ Compliance and Enforcement.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) permit Renewal 1. The draft permit authorizes the operation of a combustion installation consisting of two internal combustion engines firing natural gas, used to cool chillers, and four diesel fired exempt emergency generators. The application requests that the emission factors for two gas engines (CAT01 & CAT02) in the current permit be updated from 601.8 lbs/MMSCF to 475 lbs/MMSCF (equivalent to 1.5 g/bhp-hr) firing natural gas. As proof of exempt eligibility for the emergency generators, the facility must maintain monthly records which demonstrate that each engine is operated less than 500 hrs/yr on a 12-mo. rolling total basis. The facility nitrogen oxides (NOx) emissions will continue to be limited to 24.9 T/yr. The draft permit includes federal conditions 40CFR 60 NSPS Subpart JJJJ and 40CFR 63 Subpart ZZZZ for compliance and enforcement.
