The Town proposes the placement of 2,920 cubic feet (108 cubic yards) of stone along an 85-linear-feet stretch of an eroding bank of Wappingers Creek [Water Index No. H-101, Class B(T)], located adjacent to the end of the road within Greenvale Park. The proposed project activities are also located within the state regulated 100 foot Adjacent Area of NYS Freshwater Wetland PK-23, Class 2.

The proposal consists of disturbance to approximately 22,230 square feet of the adjacent area of DEC-regulated freshwater wetlands OL-18, OL-52, and LC-45, associated with the installation of 20,400 linear feet of 10 inch steel gas distribution piping, and the installation of a gas regulator station. Approximately 400 linear feet of pipe will be installed using Horizontal Directional Drilling and approximately 7,410 linear feet of pipe will be installed within the freshwater wetland adjacent areas.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,050 gallons per minute of water from an on-site pond for aggregate production. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes to disturb a portion of NYS Freshwater Wetland CD-7 (Class II), its 100 foot Adjacent Area, and Black Creek [WIN#H-128, Class A(T)] to construct a 1.25 mile long, 12 foot wide asphalt paved shared-use path following the general alignment of the abandoned Penn Central Railroad. Proposed activities include bridge rehabilitation, excavation, fill, and grading. The total area of disturbance to the Freshwater Wetland is 0.01 acres; the total area of disturbance to the Adjacent Area is 1.54 acres; there will be 36 linear feet of disturbance to Black Creek. The project is located parallel to the south side of NYS Route 299, from South Street to New Paltz Road, in the Town of Lloyd, Ulster County.
