Project Description:

The applicant proposes to renew and increase an existing sand and gravel LOM by 12.1 acres. With reconfigurations and some areas approved as reclaimed the LOM is being reduced from 38.7 to 31.7 within a 230 acre parcel. The project site is leased to Robinson Concrete from John Potter and is located on Miller Road in the Town of Sennett in Cayuga County. Mining is not proposed for below the local water table. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations. Mining is proposed to remove approximately 1 million cy of aggregate sand and gravel over the estimated operational life of the mine. Mine areas will be reclaimed for production of field crops and/or naturally wooded conditions. The area reviewed in this application is 12.1 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 200 gallons per minute of water from an on-site well for the purpose of golf course irrigation. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant proposes to construct a driveway through the eastern edge of the NYS Freshwater Wetland MX-1 for access to a single family residence. The driveway will cross approximately 40 feet of regulated wetland and a culvert will be installed to allow for the movement of water. Approximately 50 yards of stone will be used to construct a 12 foot wide 6 inch deep driveway through the regulated area. Siltation and erosion controls will be required to prevent any sediment from leaving the work site.

Project Description:

The applicant, Taylor Garbage Service, Inc. proposes to modify the existing Taylor Solid Waste Facility transfer station located at 5730 State Route 434, Apalachin, Town of Owego, Tioga County; to allow for plastics shredding within the existing transfer station. Plastics for shredding are received from the recycling facility at the time of shredding such that the material is brought in, processed, loaded, and hauled out by tractor trailer, on demand, to a local user. There is no stockpiling of raw or shredded plastics. The proposed shredding equipment is low rpm, low noise, and the rate is estimated at 60 tons per year in 5-ton increments.
