Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Air State Facility (ASF) Permit to JFK International Airport, an existing ASF permitted facility. The Port Authority of NY & NJ maintains and operates infrastructure at the JFK International Airport which includes roadways, runways, taxiways, and support buildings. The application continues to include buildings 141, 161, 209, 254, 269 and associated aboveground and underground storage tanks. The renewal application identifies modifications to better reflect current operating conditions, emissions units that have been removed from the facility, have been mothballed, or are otherwise classified as exempt or trivial pursuant to 6NYCRR Part 201-3. The application seeks to add two 12.55 MMBtu/hr natural gas boilers from building 208. The application seeks to add two non-exempt boilers and incorporate (exempt) emission sources from buildings 14 and 151 that the Port Authority has taken over from Japan Airlines/JLW Project Mgmt Services - JFK International Airport #151 (NYSDEC Air State Facility Permit ID# 2-6308-00202/00003). The Japan Airlines ASF permit will be discontinued upon renewal of the JFK Air State Facility permit. This modification will not cause facility-wide aggregate emissions to exceed the Oxides of Nitrogen (NOx) emission cap of 24.9 T/yr or Volatile Organic Compound (VOC) emission cap of 24.9 T/yr, including exempt and trivial activity sources. Under 6 NYCRR Subpart 201-7, the sum of emissions from the emission units specified in this permit shall not equal or exceed the following Potential To Emit (PTE) rate for each regulated contaminant: NOx 49,800 pounds/yr, and VOCs 49,800 pounds/year. The draft permit contains federal conditions for compliance and enforcement under 40CFR 60 NSPS Subpart IIII, 40CFR 63 Subpart JJJJJJ, and 40CFR 63 Subpart ZZZZ, and compliance demonstration under 40CFR 60.116b(a) NSPS Subpart Kb and 40CFR 60.116b(b) NSPS Subpart Kb.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a new Air State Facility (ASF) permit for an existing waste paper recycling facility. The ATV permit (DEC ID# 2-6403-00107/00016) will be relinquished and discontinued upon ASF issuance. This application is being submitted to downgrade the current ATV to an ASF Permit by capping emission of Oxides of Nitrogen (NOx) to 45,000 lbs/yr, Total Hazardous Air Pollutants (HAPs) to 45,000 lbs/yr, and Volatile Organic Compounds (VOCs) to 49,000 lbs/yr. The total facility-wide emissions shall be limited to: VOCs to 24.5 T/yr year for any consecutive 12 mo. period; total annual HAP emissions to 22.5 T/yr for any consecutive 12 mo.period; and any single HAP to 9.5 T/yr for any consecutive 12 mo. period. The facility is seeking to decommission and remove the existing 248 mmbtu/hr boiler with a new 249 mmbtu/hr gas fired boiler. The facility is applying to install three gas fired boilers until the new 249 boiler is up and running. The facility is limiting its NOx and HAP emissions to less than the major threshold and is capping out of the applicable requirements, 6NYCRR Subpart 201-6, 6NYCRR Subpart 227-2 for NOx and NESHAPS for HAPS and is required to have a State Facility Permit under 6NYCRR Subpart 201-5. In addition, the facility is subject to 6NYCRR Part 212 for non-criteria contaminants. This draft permit contains the following federal conditions: 40CFR 60.44b(k) NSPS Subpart Db Oxides of nitrogen standard exemption; 40CFR 60.48c(a) and 40CFR 60.48c(g) NSPS Subpart Dc: Compliance Demonstration.
