Chemung County Soil and Water Conservation District (SWCD)

Permits Applied For:

Article 24 Freshwater Wetlands, Article 15 Use and Protection of
Waters and Section 401 - Clean Water Act Water Quality Certification.

Project Location:

Countywide - Chemung County

Project Description:

New York State Department of Environmental Conservation (NYS DEC) is considering the re-issuance of a General Permit to the Chemung County SWCD to cover various stream maintenance, stabilization and crossing projects conducted by the Chemung County SWCD and their cooperators. No changes are being proposed to the previously issued General Permit. The General Permit allows the Chemung County SWCD to work with the county, towns and residents on projects that fall under the jurisdiction of the NYS DEC. These projects involve the following activities including but not limited to: the removal of trees and/or debris that are blocking or impeding navigation or drainage, removal of stream channel material, the placement of heavy rock rip rap, stone filled gabion baskets, and bed sills for bank stabilization, installation of in-stream stabilization structures, stream crossing for machinery or placement of fill/grading for stabilized ford for agricultural usage, maintenance, repair, and in-kind replacement of existing structures such as rip rap, retaining walls, culverts etc. within streambanks, stream channels and regulated NYS DEC Freshwater Wetlands and their adjacent areas, and the installation of dry hydrants within protected waterways and regulated NYS DEC Freshwater Wetlands and their adjacent areas. Once issued, the Chemung County SWCD would be required to request project-specific coverage under the General Permit for cooperating individuals and municipalities throughout the term of the permit, which would be five years.

State Environmental Quality Review:

The project is Type II action.

State Historic Preservation Act (SHPA):

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

The project is not located in a Coastal Management area and not subject to the Waterfront Revitalization and Coastal Resource Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing no later than November 29, 2017 or 15 days after the publication of this notice, whichever is later, to the contact listed below.
