Project Description:

The applicant proposes to provide erosion protection along approximately 2,500 linear feet of Chautauqua Lake shoreline within Long Point State Park. Large rock riprap will be used along 500 feet of non-accessible areas, with a mixture of softer methods including live stakes, timber edging, coir fiber shore protection, and plantings primarily above the average high lake water level along on the remaining 2,000 feet.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit NY0000574 for the discharge of treated surface wastewater to the Niagara River, a Class A-Special water. As a result of comments received, this is a re-notice of the Notice of Complete Application published in the Environmental Notice Bulletin on 4/18/2012 and 8/10/2016.

Tonawanda Engine Plant-General Motors Powertrain facility activities include manufacturing and services related to the support of vehicle engine assembly. Wastewater consists of non-contact cooling water, remediation system discharge, flow from indoor garage floor drain, and stormwater. Treatment at the facility consist of sediment/oil water separation for Outfall 01B.

DEC proposes to incorporate the following modifications to this permit: Page 1 has been updated; PCB limits have been revised; Outfalls 1A1, 1A2, 1A3 were permanently closed and deleted from the permit; Deleted Outfall 004 since waste stream has been diverted to Outfall 001; Deleted Outfall 002 as it has been converted to a bioswale; Condition #3 (Mobilized Portable Activation Carbon Treatment System) has been updated; PCB Minimization Program requirements have been updated; Inclusion of Biological Monitoring Requirements for the cooling water intake structure; Water Treatment Chemical condition has been updated; Updated Best Management Practices, and the Monitoring Locations page; Groundwater Monitoring Program has been removed as no detectable concentrations of parameters have been recorded; Renamed the Schedule of Compliance page to Special Conditions - Schedule of Submittals which summarizes deliverables/action items in the permit.

Project Description:

The Department has made a tentative determination to approve an application for the hand-clearing of 4,000 linear feet of 6-foot-wide recreational access trails, the expansion and deepening of an existing pond, and the hand-clearing of a 20 foot wide picnic area along the pond within New York State Freshwater Wetland BA-8 located on Hosmer Road in the Town of Hartland. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
