Project Description:

The applicant proposed disturbance to freshwater wetland PK-2 and its adjacent area associated with raising the elevation of the existing road to 1.5 feet above the current 100-year flood level. The proposed disturbance includes new fill as well as excavation of old fill for the establishment of a 12-foot long opening in the existing causeway to allow tidally-influenced flow between the wetland sections.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to approve this application to modify a SPDES permit (#NY 0083089) for subsurface discharge, from 40,900 gallons per day (gpd) to a total design flow of 47,310 gpd, of treated sanitary wastewater from the Frost Valley YMCA Facility, a year-round environmental education center and camp complex. The project includes construction of 23 proposed new cabins, two new internal roadways, new amphitheater and parking lot, and various drainage improvements. Due to proposed new construction and alteration of existing cabins, the proposed modification will add seven (7) new wastewater outfalls (total of 45 outfalls) at the YMCA facility. Wastewater disposal systems on the 2,000-acre site consist of septic tanks and leach fields or seepage pits. Proposed work also includes construction of an 80 linear feet portion of 15" diameter culvert within an intermittent stream (Class C) adjacent to Lake Cole, and replacement of two existing culverts (36" & 48" respective diameters) within an unnamed tributary to the West Branch Neversink River, Class C(t), with new 83" x 57" arch culvert in each location. The project is located on Frost Valley Road in the Town of Denning, Ulster County. A draft permit is available for inspection and comment at the regional office.

The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
