Project Description:

The Applicant proposes to implement a Citywide Ferry Service (CFS) that would provide an affordable and convenient transit option to residents in otherwise transit-isolated neighborhoods. The proposed CFS would expand on the existing East River Ferry (ERF), a privately operated commuter and recreational transit service paid for and managed by the City of New York and NYCEDC. Multiple new and upgraded ferry landings will be required, this application is for the one located at E 90th St., east of the E 90th St and East End Ave connection and connected to the Bobby Wagner Walk, Block 1587 Lot 27 and Block 1592 Lot 1 in Manhattan. The Applicant proposes to reorient the existing 35 foot by 90 foot barge and construct a 75 foot by 10 foot gangway with passenger queuing, information kiosk, and ticket machine for this landing.

Project Description:

The site is accessible by crosswalks underneath the elevated FDR Drive located at the intersections of East 20th Street and Avenue C to the north of the site, and East 18th Street and Avenue C to the south of the site. The Applicant proposes to construct a gangway landing 15 foot by 10 foot, two (2) 80 foot by 10 foot gangways connected to a 35 foot by 90 foot barge, with passenger queuing information kiosk, and ticket machine for this landing.

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V Renewal 3 (ID# 2-6403-00014/00031) and Title IV Renewal 1 (Phase II Acid Rain, ID# 2-6403-00014/00054) for an existing electricity generating facility that operates two very large residual fuel and natural gas boilers rated at 3717 MMBtu/hr and 5502 MMBtu/hr and one medium natural gas 65 MMBtu/hr boiler. The facility has one 235 MMBtu/hr combustion turbine that can combust distillate fuel oil or natural gas. There are two lube oil vapor extractors. Emergency coal burning capabilities exist at the facility. Facility emissions of Nitrogen Oxides are averaged with other facilities owned by NRG Energy Inc. according to a system-wide averaging plan approved by the Department to verify compliance with 6NYCRR Part 227-2. The facility must demonstrate compliance with BART (Best Available Retrofit Technology). This Title V renewal continues to include Compliance Certifications under 6NYCRR 227-2.4(a)(1)(ii), 6NYCRR 227.2(b)(1), 6NYCRR 227-2.6(c), and 6NYCRR 227-2.4(c)(1)(ii).

This ATV renewal continues to include 6NYCRR 249.3(a) for Emission Unit A-K0001 necessary to ensure compliance with the BART requirements under EPA's Regional Haze program for Boiler # 30, the facility's annual emissions of Particulates are limited to a maximum of 359 T/yr. This ATV renewal continues to include federal conditions: 40CFR 60.48c NSPS Subpart Dc, 40CFR 63 Subpart DDDDD, 40CFR 63.7495(b) Subpart DDDDD, 40CFR 63 Subpart UUUUU, 40CFR 63.6585 Subpart ZZZZ, 40CFR Part 68, and 40CFR 82 Subpart F. This facility is subject to the Title IV Acid Rain Regulations found in 40CFR Parts 72, 73, 75, 76, 77 and 78.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
