Project Description:

The Department has prepared a draft permit (SPDES #NY 02569573) and made a tentative determination to approve a reissuance and permit modification for the discharge of up to 100,000 gallons per day of treated sanitary wastewater to Canaseraga Creek, a Class C(t) waterbody.

The following changes to the permit are proposed: Updated language for standard permit conditions was added as well as a low priority mercury minimization plan. No changes to effluent levels were made.

The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (the Department) has received and made a tentative determination to approve an application for a proposed expansion of the Redland Quarries NY Inc. Lockport Quarry. The Department, as lead agency, has also accepted a Draft Environmental Impact Statement (DEIS) on the proposed expansion. The proposed action involves an approximately 243.4 acre expansion of the Lockport Quarry, including mining of approximately 220.9 acres and approximately 22.5 acres of overburden berm storage areas. The proposed excavation areas are proposed on the south side of Hinman Road in the Town of Lockport across from the existing quarry. The overburden will be stockpiled in protective noise/visual berms along quarry perimeters. The proposed reclamation plan is to create two lakes to provide recreational opportunities and wildlife habitat. The proposed quarry expansion would extend the life of the mine for approximately 40 years.

Copies of the DEIS are available at the Lockport Public Library located at 23 East Avenue, Lockport, NY 14094, Lockport Town Hall located at 6560 Dysinger Road, Lockport, NY 14094 and online at www.lockportquarry.com. A copy of the DEIS as well as additional information relative to this application may also be obtained by contacting the contact person listed below. It is recommended that an appointment be scheduled by phone to review the files in the Department's Region 9 Office. The Department will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 AM through 4:45 PM), unless the requester wishes to inspect the files at a later date.

As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
