Project Description:

Copenhagen Wind Farm LLC (the Applicant) is proposing to modify their existing permit to develop a wind-powered generating facility. The requested modification to the Article 24 Article 24 Freshwater Wetlands Permit will increase 0.38 acre increase in temporary impacts (clearing) to NYSDEC-jurisdictional wetlands and a 1.09 acre increase in temporary impacts to 100' adjacent areas. Project modifications have also increased permanent impacts to NYSDEC-jurisdictional wetlands by 0.0003 acre increase and decreased permanent impacts to the 100' adjacent area by 0.0006 acre. Changes include 13,303 square feet of temporary impacts (clearing) to Wetland RU-25 and 3,359 square feet of temporary impact (clearing) to Wetland RU-19. Permanent impacts changes include 12.5 square foot increase to Wetland RU-25 with a decrease of 25 square feet impact to the 100' adjacent area of Wetland RU-25.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Copenhagen Village Board

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
