Public Notice

Petroleum Bulk Storage (PBS) Program - Notice of Authorization for Delegation of PBS Program to Westchester County

Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) has, by a Commissioner's letter dated September 13, 2017, and an Order dated October 3, 2017, approved Article XXV of the Westchester County Sanitary Code, Petroleum Bulk Storage, that establishes a new County petroleum bulk storage (PBS) program. This action is taken under 6 NYCRR § 613-1.7 which provides the regulatory processes for NYS DEC to consider an application for approval of a local law or ordinance establishing a local PBS program, impose conditions for approval, and rescind a previous approval.

All previous Orders regarding the establishment and implementation of a PBS program in Westchester County, including the Order dated March 23, 1998 and the Interim Order dated April 10, 2017, are superseded by the terms of the October 3, 2017 Order.

Negative Declaration

Orange County - The Town of Wallkill Planning Board, as lead agency, has determined that the proposed Devitt Management - Phase 1A - Hotel Pad Site will not have a significant adverse environmental impact.

The project consists of the development of a 43.5 acre former dairy farm along an Interstate Highway into an integrated commercial center, with several pad sites, which are separated into various phases of development. Phase 1A consists of a 93 room motel in a four story building. Because the Applicant hasn't identified any particular uses that incorporate into subsequent phases of the development, the Applicant will submit a consistency statement and perform a post development implementation traffic study after completion of Phase 1 and prior to obtaining approval for construction of future phases. The project is located at 599 East Main Street, in Middletown, Town of Wallkill, New York.

Ulster County - The Town of Rosendale Town Board, as lead agency, has determined that the proposed Tillson Garden Apartments will not have a significant adverse environmental impact. The action involves a zoning map amendment and Local Law adoption for an adaptive reuse of the former Tillson School for 32 units of apartments upon 8.4 acres of land currently zoned Residential R-1/R-2 and which lands are to be rezoned to Economic Enterprise Overlay Zone (EEO) and Community Development District (CD). The project is located at 56 Grist Mill Road in the Town of Rosendale, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Dutchess County - The Town of Poughkeepsie Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed MacDonnell Heights Town Center. A public hearing on the Draft EIS will held on October 19, 2017 at 6 p.m. at the Town of Poughkeepsie Town Hall, Meeting Room, 1 Overocker Road, Poughkeepsie, NY 12603. Written comments on the Draft EIS will be accepted until ten (10) days after close of Public Hearing. A hard copy of the Draft EIS is available at the Town of Poughkeepsie Town Clerk; the Town of Poughkeepsie Planning Department, Town Hall, 1 Overocker Road, Poughkeepsie, NY 12603 and on line at: http://www.townofpoughkeepsie.com.

The action involves development of a Town Center as a mixed-use, pedestrian friendly, residential and commercial development with up to 390 residential dwelling units in apartments and townhomes; 85,000 to 180,000 square feet of commercial and non-residential space, recreational amenities, parking and water supply sewage collection and treatment, and storm water control facilities. The project is located 928, 932, 935 and 936 Dutchess Turnpike and Victory Lane in the Town of Poughkeepsie, New York.

Notice of Acceptance of Final SEIS

Orange County - The Town of New Windsor Planning Board, as lead agency, has accepted a Final Supplemental Environmental Impact Statement on the proposed Patriot Bluff Luxury Apartments. A hard copy of the Final SEIS from the contact listed below on online at: http://town.new-windsor.ny.us/OfficialsDepartments/MunicipalBoards/PlanningBoard.aspx.

The project involves an application to amend a previously Town approved Site Plan for the 178 unit Patriot Bluff Condominium project, to allow 310 luxury market rate apartments on an existing 55 acre site. The project is located northwest of the intersection of Routes 300 and 32 in the Town of new Windsor, New York.

Notice of Acceptance of Final EIS

Westchester County - The Town of Harrison Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Avalon Bay Harrison. The Final EIS is available from the contact listed and online at: https://www.harrison-ny.gov/planning-board. The action involves an amendment of the Town/Village of Harrison Zoning Code to establish a new Transit Oriented Development (TOD) District; an amendment of the Town/Village Zoning Map to rezone the project site TOD District; TOD special permit approval; and site plan and subdivision approvals, for the redevelopment of an approximately 3.79 acre site on Halstead Avenue as a mixed-use project with 143 multifamily residential units, approximately 27,000 square feet of commercial/retail space, and on-site parking, including a 475 space garage to be owned by the Metropolitan Transportation Authority and used for Metro-North Commuter Railroad commuter parking. The project is located at Halstead Avenue and Harrison Avenue in the Town of Harrison, New York.
