The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to install and operate the Bernhards Bay Water District along various roads in the Town of Constantia. During construction the following regulated NYS Freshwater Wetland areas will impacted; the Adjacent Area to MA-1 along Lower Road, the Adjacent Area to PL-16 along Johnson Road, and the Adjacent Area to PL-49 along Railroad Street. Streams along the following roads will be directionally bored under to avoid impacts; Lower Road, Johnson Road, and Rt 49 near Railroad Road and Martin Drive. Erosion and sediment controls will be required during construction to prevent contravention of water quality standards.

SEQR Lead Agency: Constantia Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant, F. S. Lopke Contracting, Inc. is proposing to mine 109.6 acres of sand and gravel deposit within a 123.7-acre life of mine area on 215.3 acres of land owned by the applicant and located on Ayers Road in the Town of Tioga, County of Tioga. Mining will include dredging of materials below the water table and final reclamation will be three open water ponds: 84.3 acres, 8.1 acres, and 1.9 acres and open grasslands.

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.
