Project Description:

The applicant proposes excavation within an unnamed tributary of Cold Spring Creek, NYS Water Index Number H-101-31-6 P5883, class B, known locally as Wilcox Park Swimming Lake. The project involves maintenance dredging of approximately 1,000 cubic yards of material from the lake, regrading the swimming area and beach, and minor repairs to Wilcox Park Lake Dam.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

The proposed action is subject to CP-29. An enhanced public participation plan was submitted by the applicant and has become part of the complete application.

The applicant proposes disturbance to tidal wetlands classified as littoral zone, fill in the Hudson River, and construction of platforms over the water, associated with the completion of the shoreline rehabilitation and access improvement previously approved under DEC permits 3-5518-00801/00002, 3-5518-00801/00005, & 3-5518-00801/00006. The project includes cutting the existing bulkhead and placing riprap waterward of the bulkhead to form a new sloped riprap shoreline and construction of fishing platforms to improve public access. Total project area is 2,010 linear feet of bulkhead, placement of 22,928 cubic yards of fill below Mean High Water, and construction of three fishing platforms.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a State Facility Permit renewal for Blythedale Children's Hospital. Emission sources include three Cleaver Brooks boilers and four chillers that use SI RICE engines. Emissions of oxides of nitrogen will be limited to below major source thresholds, as defined in 6NYCRR Part 201. Therefore, the facility is not subject to the requirements of Title V of the federal Clean Air Act.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

Persons wishing to inspect the subject files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
