Project Description:

Hamlin Beach State Park has proposed to construct a centralized wastewater treatment facility and a wastewater collection system throughout the park. The new sysem will include a mix of gravity and low-pressure sanitary collection sewers conveying wastewater from each building in the park and will replace a collection of aged septic systems. The main sewer in the park will carry wastewater to a membrane bioreactor treatment plant (MBR) located in the south portion of parklands near a maintenance building located between Moscow Road and the Lake Ontario State Parkway, before discharging to a tributary of Yanty Creek. The project will involve temporary disturbances to regulated 100-foot adjacent area of freshwater wetland (HM-6) for the installation of a sewer line. The modification of the SPDES permit will allow for the discharge of an average of 25,000 gallon per day of treated sanitary wastewater to the tributary of Yanty Creek. The project will also include the placement of a SPDES outfall to the tributary of Yanty Creek and the placement by directional drilling of a sewer line beneath four regulated streams.

The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law along with the other associated permits. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. For erosion control, the applicant proposes to place 1 to 4 ton rock in front of an existing rock revetment along approximately 136 feet of Lake Ontario shoreline. Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 400 gallons per minute of water from the Erie Canal for the purpose of golf course irrigation. The facility has been in operation since 1980. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the

Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
