Project Description:

The applicant proposes to modify the mining permit for the operation of an existing limestone quarry. The modification involves the addition of 7.1 acres of land southwest of the currently approved life of mine area, and the removal of 11.9 acres never affected by mining from the current life of mine area along the western edge. The currently approved life of mine area is 30 acres. The modified life of mine area is 25.2 acres. No changes to the processing plant, traffic patterns, or anything related to activities outside of excavation are proposed. The project site is the applicant's property, located approximately 5 miles southeast of Cape Vincent and 2,000 feet east of NYS Route 12E. The site access road intersects NYS Route 12E approximately 1,700 feet north of Fox Creek Road in the Town of Cape Vincent, Jefferson County. The mine is intended to operate as a traditional surface extraction of consolidated limestone. Mining is proposed for below the local water table. The quarry will be worked using standard drilling and blasting techniques. Existing overburden will be removed and stored in a perimeter berm for future reclamation use. Processing of materials will consist of crushing and dry screening. Aggregate washing is not proposed. Final reclamation will restore the site to a +/- 25 acre open water surface within uniformly graded and re-vegetated open land. Up-land reclamation will include the replacement of stockpiled overburden/topsoil, and re-seeding with an approved USDA SCS seed mixture. The reviewed addition of life-of-mine area is 7.1 (LOM) acres.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

DEC received an application to renew an existing Air Title V permit to operate air pollution sources for the facility located on Bostwick St., Town of Lowville, Lewis County, New York. This facility is engaged in the manufacture of various types of products for books and folders. The Standard Industrial Classification representative of this facility is 2672, Coated and Laminated Paper. DEC has made tentative determination to renew the permit and drafted a Title V Facility Permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law. The draft permit also reflects a recent change of ownership of the facility.

This permit allows for the operation of 2 natural gas only boilers (Emission Unit 0-00001), 5 aqueous coaters, 2 aqueous printers, 2 solvent printers, their associated dryers, coating and ink mixing and dispensing operations, and wastewater treatment operations (Emission Units 0-00002 & 0-00005), and a waterbased coating makeup room (Emission Unit 0-00003). The facility has potential emissions of Hazardous Air Pollutants (HAP) and Volatile Organic Compounds (VOC) above the major source thresholds. The facility utilizes two boilers firing natural gas only that are subject to part 227. The paper coating operations are subject to the VOC RACT (Reasonable Available Control Technology) requirements of 6 NYCRR Part 228, Surface Coating Processes and the National Emission Standards for Hazardous Air Pollutants of 40 CFR 63 Subpart JJJJ, Paper and Other Web Coating. The printing operations are subject to the VOC RACT requirements of 6 NYCRR Part 234, Graphic Arts and the National Emission Standards for Hazardous Air Pollutants of 40 CFR 63 Subpart KK, Printing and Publishing Industry and 40 CFR 63 Subpart HHHHH for the manufacture of coatings to be used at their other facilities.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department received an application to renew the existing Air Title V and Air Title IV Permits permit at the Sterling Energy Facility, a cogeneration facility that provides for the production of electricity to the grid and potentially steam to a host facility.

The Department has made a tentative determination to approve the request of Sterling Energy and has devolved a draft permit in accordance with Environmental Conservation Law Article 19 (Air Pollution Control) The renewal of the Title V Permit allows the operations of emission unit 1-CMBTN, which includes one (1) gas turbine/Heat-Recovery Steam Generator (HRSG) unit with steam injection, one(1) auxiliary boiler firing natural gas, and one (1) 1100KW auxiliary generator firing distillate oil. The facility is intended to provide steam to a host facility. The facility is not subject to PSD, however, it is subject to NSPS. This renewal will only address changes to applicable regulations.

Specific changes include updated conditions under 6 NYCRR Part 225-1, Fuel Composition and Use, lowering the acceptable amount of sulfur in Number 2 fuel oil. New York State Regulations, 6 NYCRR 237 - Acid Deposition Reduction NOx Budget Trading Program, and 6 NYCRR 238 - Acid Deposition Reduction SO2 Budget Trading program have been repealed and removed from this permit. Further, the CAIR requirements under 6 NYCRR Parts 243, 244, and 245 have been removed and replaced with CSAPR rules under 40 CFR Part 97, Subparts AAAAA, BBBBB, and CCCCC.
