Permit(s) Applied for:

Article 15 Title 5 Excavation & Fill in Navigable Waters
Article 25 Tidal Wetlands
Section 401 - Clean Water Act Water Quality Certification

Project is Located:

Brookhaven, Suffolk County

Project Description:

The applicant proposes to remove concrete rubble rip-rap from the edges of a solid fill pier and replace it with 2 - 2.5 ton boulders underlain by a 12-inch deep layer of 40 - 50 pound stone on geotextile fabric. Clean fill is proposed to be placed on the low elevation, landward portion of the pier to increase the elevation by 1 foot. Vegetated intertidal marsh is present along the base of the pier and is interspersed between pieces of concrete rubble in areas which are proposed to be excavated prior to the placement of the new boulder rip-rap. High marsh vegetation extends onto the low elevation, landward portions of the solid fill pier in the area which is proposed to be filled. Thus, the project as proposed would result in the destruction of intertidal and high marsh vegetation in a NYSDEC-regulated tidal wetland. Planting of approximately 390 sq. ft. of high marsh vegetation landward of the boulders is proposed as mitigation. The purpose of the proposed project is to stabilize / maintain the solid fill pier. The proposed project is located at 73 Shore Road in Setauket, Town of Brookhaven in Suffolk County, SCTM# 200-63-3-7.2, 7.3.10.
