Project Description:

The applicants propose to conduct a stream restoration project as part of the Delaware County Soil and Water Conservation District's Emergency Stream Intervention training as a result of a 2017 flood event. The project goals are to establish functioning hydraulic geometry and planform to convey the bankfull discharge, increase floodplain connectivity to reduce near-bank stress and restore functioning alluvial processes, increase bed-form diversity and refuge locations for aquatic organisms by creating stable riffle-pool sequences, establish a riparian forest buffer, install hardened riffles for grade control, remove existing berm, create bankfull bench, and install rock rip rap bank stabilization. The project fill components consist of constructing hardened riffles using rock rip rap, glide protection structure, bank stabilization using rock rip rap. Total length of project is 600 feet. The project is located on County Highway 22 approximately .5 miles north east of MacGibbon Hollow Road and County Highway 22 intersection.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department intends to modify the existing State Pollutant Discharge Elimination System permit from a discharge of 11,550 gallons per day to 15,000 gallons per day of treated wastewater to groundwater from a secondary treatment system at Net Zero Apartments, located at 1020 Burdeck St. in the Town of Rotterdam. This tentative determination indicates that the increased discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for, or endorsement of, the activity for which a permit is sought.
