Project Description:

Seneca Foods Corporation has submitted an application for renewal of the Title V Facility Permit for its Seneca Foods Marion Plant, a can manufacturing facility located on Mill St in the Town of Marion. Minor changes have been made to the permit to reflect the removal of a can end sealing machine and to indicate the facility address is at 3709 Mill St. Emissions are from can manufacturing, which include welding and coating operations.

The facility remains subject to 6 NYCRR Part 201‑6, Title V Facility Permits for major stationary sources, due to potential emissions of volatile organic compounds (VOC) in excess of 50 tons per year.

As in the previous Permit, the Draft Permit includes a condition that will continue to restrict emissions of hazardous air pollutants (HAP) to below the 25 ton per year threshold in 40 CFR Part 63 Subpart KKKK National Emission Standards for Hazardous Air Pollutants (NESHAP) for Surface Coating of Metal Cans, by requiring documentation that facility coating and solvent use does not cause HAP emissions to exceed 23 tons in any 12 month period.

In response to the application, the Department has generated a Draft Title V Facility Permit, made a tentative determination to renew this Title V Facility Permit, and has made a tentative determination to send the Draft as a Proposed Permit to EPA for review, if comments received do not raise significant issues that must be addressed.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

Waste Management of New York, LLC (WMNY) is proposing to add a western rail connection along the CSX right-of-way, running westward from the current connection at the High Acres Landfill & Recycling Center. This new connection will allow trains to enter and exit the WMNY facility in either direction from the main CSX rail tracks. The project will involve the relocation of 100 feet of railway, and the placement of a 500 foot long rail line to the WMNY facilities. An existing access road will also be relocated to accommodate the rail line. The site work will consist of clearing, regrading and the placement of the rail tracks upon existing ballast at the site. The project includes approximately 0.42 acres of physical disturbance within the regulated adjacent area of NYS freshwater wetland (PR-1). No changes in the types or quantity of wastes received at the facility are proposed.
